公私合作执行行政任务的国家责任探析

【摘要】：国家责任是国家历经不同阶段逐渐演进而形成的制度。公私合作执行行政任务中,国家任务履行主体和履行方式的变迁促使国家责任形式发生转变。公私合作执行行政任务中,国家责任分两种类型:涉及公权力行使的和不涉及公权力行使的。涉及公权力行使的国家责任包括两种情况:其一,私人属于授权行使公权力的,私人承担国家责任;其二,私人属于委托行使公权力的,由行政机关承担国家责任。不涉及公权力行使的国家责任,国家责任表现为行政机关负担保责任。
[Abstract]:State responsibility is a system formed by the gradual evolution of the state through different stages. In the administrative task of public-private cooperation, the change of the main body and mode of state task makes the form of state responsibility change. In public-private cooperation, there are two types of state responsibility: those involving the exercise of public power and those not involving the exercise of public power. The state responsibility involving the exercise of public power includes two situations: one is that the private person is authorized to exercise the public power, the private person bears the state responsibility; the other is that the private person is entrusted with the exercise of the public power, the administrative organ shall bear the state responsibility. State responsibility, which does not involve the exercise of public power, is the responsibility of the administrative organ.
