劳动法律规制中就业目标与经济目标实现的理性

【摘要】:虽不能将我国当前"经济下行"的发展现状完全归因于劳动立法,却也并非与其毫不相干。以劳动法律规制目标的理性为切入点,汲取现有立法仅着眼于劳工薪酬意义上的就业目标实现的经验教训,可洞悉疏离于劳工非薪酬意义上(尤其是精神意义上的)的就业目标及企业持续之经济目标实现的弊害。通过企业等团体组织凝聚力的保持与固化、企业等团体组织与劳工个体创新力的保持与加强、就业数量与就业质量目标以及企业经济目标与就业目标的协调等,特别是劳动者精神就业目标对企业经济目标的实现,可以使所创制的劳动法律制度在兼顾劳动者与企业利益的同时实现企业发展所需科技及创新力的落实、提高,它是"经济上行"发展的精神性制度。
[Abstract]:Although we can not attribute the present situation of "economic downturn" to labor legislation, it has nothing to do with it. Based on the rationality of the goal of labor law regulation, the author draws the experience and lessons that the existing legislation only focuses on the realization of the employment goal in the sense of labor compensation. We can discern the disadvantages of the employment target in the sense of alienating labor's non-salary (especially in the spirit sense) and the realization of the enterprise's sustained economic goal. Through the maintenance and solidification of the cohesive force of organizations such as enterprises, the maintenance and strengthening of the innovation power between enterprises and individual workers, the coordination between the quantity of employment and the quality of employment and the economic objectives of enterprises and the objectives of employment, etc. In particular, the realization of the goal of laborer's spiritual employment to the economic goal of the enterprise can make the created labor legal system realize the implementation of the scientific and technological and innovative power needed for the development of the enterprise while taking into account the interests of the laborer and the enterprise. It is the spiritual system of "economic uplink" development.
