我国宗教法人制度的立法完善

【摘要】：提高宗教工作法治化水平,用法律规范政府管理宗教事务的行为,用法律调节涉及宗教的各种社会关系,是加快建设法治中国、推进国家治理体系和治理能力现代化的重要环节。宗教法人制度的深入研讨和立法完善,则是这一实践进程的核心问题和基本前提。文章首先对《民法通则》关于社会组织之民事主体资格问题予以厘清,并在辨析宗教法人概念、指出《条例》有关规定不足的基础上,分别对宗教团体法人制度、宗教活动场所法人制度和宗教院校法人制度的立法完善进行理论联系实际的深入研究,强调应以国家立法机关制定《民法总则》和最高行政机关修订《宗教事务条例》为契机,依法确定宗教主体的法人资格、认定程序和条件,促进宗教事业发展。
[Abstract]:To improve the level of the rule of law in religious work, to regulate the government's behavior in managing religious affairs by law, and to regulate all kinds of social relations involving religion by law is to speed up the construction of a country governed by the rule of law. To promote the national governance system and governance capacity modernization of an important link. The research and legislation perfection of religious legal person system is the core problem and basic premise of this practice process. The article first clarifies the civil subject qualification of social organizations in the General principles of Civil Law, and on the basis of discriminating and analyzing the concept of religious legal person, points out that on the basis of the insufficiency of the relevant provisions of the regulations, the system of the legal person of religious organizations is separately analyzed. The legislative perfection of the legal person system in the place of religious activities and the legal person system in religious colleges and universities has been deeply studied in theory and practice. It is emphasized that the opportunity should be taken by the state legislature to formulate the General principles of Civil Law and the Supreme Administrative organ to amend the regulations on religious Affairs. To determine the legal personality, procedures and conditions of religious subject according to law, and to promote the development of religious cause.
