行政法视野下政府公共服务外包范围研究

【摘要】：公共服务外包源于西方，其核心是在公共服务供给中引入市场竞争机制，实现供给主体的多元化，从而提高公共服务的供给效率和质量，更好地满足公众多样化的公共服务需求。本文主要从界定我国政府公共服务外包的范围着手，通过系统梳理国内外有关公共服务外包范围研究的有关成果，理清与公共服务外包相关的概念，在审视公共服务外包实践的基础上，从行政法视野推进对公共服务外包的理论研究，以为构建我国政府公共服务外包体系提出一些建议。文章认为，，我国公共服务外包体系构建必须立足于国情之上，与社会主义市场经济体制改革进程相一致，与建设服务政府的进程相一致，必须纳入行政管理体制改革的整体框架下予以推进，要清晰界定公共服务外包的范围，防止过度外包。要明确政府在公共服务外包中的角色定位，外包不是政府公共服务责任的解除，只是政府公共服务责任实现方式的转变。要完善法律法规体系和制度建设，强化政府的监管责任，遏制外包过程中的权力寻租和腐败。本文共分为六章。第一章主要论述了文章的选题背景、研究意义、研究方法、研究框架。第二章主要阐释了与公共服务外包相关的一些基本概念，如公共物品、公共服务、公共服务外包、公共服务市场化、公共服务社会化等。第三章对域外政府公共服务外包的范围进行了有代表性的考察并总结了对我国公共服务外包范围界定的有效借鉴。第四章系统的整理了我国政府公共服务外包范围现有法律的详细规定并针对具体案例分析现有的治理情况。第五章指出了有效界定我国政府公共服务外包范围的思路，并提出了相关建议。最后是结语，概述了全文的研究结论，并提出了研究中的一些不足之处。
[Abstract]:Public service outsourcing originates from the west, the core of which is to introduce the market competition mechanism into the public service supply, so as to realize the diversification of the main body of supply, so as to improve the efficiency and quality of the public service supply. Better meet the diverse public service needs. This paper mainly starts from defining the scope of public service outsourcing of our government, through systematically combing the relevant achievements of the research on the scope of public service outsourcing at home and abroad, and clarifies the concepts related to public service outsourcing. On the basis of examining the practice of public service outsourcing, this paper advances the theoretical research on public service outsourcing from the perspective of administrative law, and puts forward some suggestions for the construction of our government's public service outsourcing system. The construction of China's public service outsourcing system must be based on the national conditions, consistent with the reform process of the socialist market economy system and the process of building the service government. It must be brought into the overall framework of the reform of administrative system, and the scope of public service outsourcing should be clearly defined to prevent excessive outsourcing. To define the role of government in public service outsourcing, outsourcing is not the release of government public service responsibility, but the transformation of government public service responsibility. This paper is divided into six chapters to perfect the system and system construction of laws and regulations, strengthen the responsibility of government supervision and control the power rent-seeking and corruption in the process of outsourcing. The first chapter mainly discusses the background, research significance, research methods and research framework. The second chapter mainly explains some basic concepts related to public service outsourcing, such as public goods, public service outsourcing, public service marketization, public service socialization and so on. The third chapter has carried on the representative inspection to the extraterritorial government public service outsourcing scope and summarized the effective reference to our country public service outsourcing scope definition. The fourth chapter systematically collates the detailed provisions of the existing laws of the scope of government public service outsourcing and analyzes the existing governance situation in the light of specific cases. The fifth chapter points out the effective definition of the scope of government public service outsourcing, and puts forward some relevant suggestions. At last, the conclusion is summarized, and some deficiencies in the research are put forward.
