【摘要】：土地资源是指可供利用的人类生存必须的基础资料,我国土地总量相对丰富,土地利用的类型齐全,但人均土地资源占有量较小,各类土地类型占比不尽合理,耕地、林地较少,难利用土地多。黑龙江垦区目前已成为全国规模较大、机械化程度较高的国有农场经济区域,是国家重要的商品粮生产基地和农副产品加工基地。黑龙江垦区分布在全省12个(地)市和69个县(市、区)内,辖区总面积5.54万平方公里,占黑龙江省土地面积的12%,其中耕地面积3975万亩。黑龙江垦区一直以来为国家的粮食安全提供坚实的保障,其土地资源开发利用是否科学合理,关乎着国家安全,同时,也是建设‘和谐社会极其重要的组成部分。所以,保护黑龙江垦区土地资源十分重要。黑龙江垦区土地资源法律保护在不同的时代背景下经历着不同的发展和变迁,直至今日,垦区仍然主要依靠国家出台的相关法律法规进行管理,这些法律法规多从全国一般情况出发,对土地资源保护相关情况进行了规定,但对垦区的特殊情况不能全面覆盖,这使得黑龙江垦区土地资源未能受到有效保护。本文运用文献研究法,对黑龙江垦区土地资源法律保护的现状进行了分析；运用个案研究法和比较研究法,对国外发达国家的先进保护经验进行了研究。全文共分为引言、正文、结论三个部分,其中正文分为五部分。第一部分为对黑龙江省垦区土地资源法律保护制度的立法现状进行分析。第二部分通过对我国耕地保护法律制度的立法发展过程和制度现状进行了研究,得出了目前制度的基本内容,从而发现垦区土地资源保护现存制度中存在的问题,并加以分析。第三部分为部分国家土地资源法律保护的经验借鉴。介绍了部分国家的土地资源法律保护先进经验,部分国家为美国、英国、日本、俄罗斯、韩国和法国。第四部分主要发现黑龙江垦区土地资源法律保护存在的问题。第五部分提出加强垦区土地法律保护制度的对策。通过前文的问题和先进经验的研究分析,结合垦区的实际情况,提出对黑龙江垦区土地资源法律保护完善的对策。
[Abstract]:Land resources refer to the basic information necessary for human survival. The total amount of land in our country is relatively rich, the types of land use are complete, but the per capita amount of land resources is small, the proportion of all kinds of land types is unreasonable, and the cultivated land, Forest land is less, difficult to use more land. Heilongjiang Reclamation area has become a large scale and high degree of mechanization of the state-owned farm economic area is an important commodity grain production base and agricultural and sideline products processing base. Heilongjiang Reclamation area is distributed in 12 cities and 69 counties in the province, with a total area of 55400 square kilometers, accounting for 12 acres of land area in Heilongjiang Province, including 39.75 million mu of cultivated land. Heilongjiang Reclamation area has been providing a solid guarantee for national food security. Whether the development and utilization of land resources is scientific and reasonable is related to national security and is also an extremely important part of building a harmonious society. Therefore, the protection of land resources in Heilongjiang reclamation area is very important. The legal protection of land resources in Heilongjiang Reclamation area has undergone different development and changes under different background of the times. Up to now, the reclamation area still mainly depends on the relevant laws and regulations issued by the state to carry on the management. Most of these laws and regulations set out from the general situation of the whole country, but the special situation of reclamation area can not be completely covered, which makes the land resources of Heilongjiang reclamation area unable to be effectively protected. This paper analyzes the present situation of the legal protection of land resources in Heilongjiang Reclamation area by using the method of literature research, and studies the advanced protection experience of developed countries by using the method of case study and comparative study. The full text is divided into three parts: introduction, text and conclusion, among which the text is divided into five parts. The first part is the analysis of the legislative status of the land resources legal protection system in Heilongjiang reclamation area. The second part has carried on the research to our country cultivated land protection legal system legislation development process and the system present situation, has obtained the present system basic content, thus has discovered the reclamation area land resources protection present system existence question, and has analyzed. The third part is the experience of legal protection of land resources in some countries. This paper introduces the advanced experiences of land resources protection in some countries, including the United States, Britain, Japan, Russia, South Korea and France. The fourth part mainly finds the problems existing in the legal protection of land resources in Heilongjiang Reclamation area. The fifth part puts forward the countermeasures to strengthen the land legal protection system in reclamation area. Through the research and analysis of the previous problems and advanced experience, combined with the actual situation of the reclamation area, the countermeasures to perfect the legal protection of land resources in Heilongjiang reclamation area are put forward.
