土地征收中农民补偿权的实现研究

【摘要】：随着我国现代化社会建设的加速,更多的土地被开发和利用来满足社会发展的需要,征地作为一种行政行为必然会涉及到征地中农民权利方面问题,由于在征地的过程中存在违法征地、粗暴执法、拖欠补偿费等行为,这使得农民在被征地时其补偿权利无法实现。经收集查阅研究相关报道和新闻资料,征地中农民补偿权利不能实现的问题已相当严重。因此,关于征地中农民补偿权实现问题的研究是一个很重要的课题。我国的征地步伐加快,被征地农民权利难以保障,对我国社会主义的建设和农业的发展极为不利,容易导致新的社会矛盾和冲突。在我国现有的法律制度中,农民在土地征收过程中其权利遭到侵害时,难以找到真正保障其补偿权的法律及畅通的救济途径,使得农民补偿权得不到实现,这不利于社会主义法治社会的稳定和发展,不利于构建一个和谐社会。针对被征地农民补偿权难以实现的情况,对问题深入分析,提出相应措施,包括设立被征地农民拒绝征地权、设立农民评估议价权、设立提出争议不影响受偿的权利、设立提起行政诉讼的权利。通过完善被征地农民法律权利,在法律上保障被征地农民的征地补偿权,从而解决农民在征地过程中补偿权无法实现的问题和不公平待遇。
[Abstract]:With the acceleration of the construction of modern society in China, more land has been developed and used to meet the needs of social development. As an administrative act, land expropriation will inevitably involve the rights of farmers in land expropriation. Due to the illegal land requisition, rough law enforcement, default compensation and other acts in the process of land expropriation, this makes it impossible for farmers to realize their compensation rights when they are expropriated. Through collecting and consulting related reports and news materials, the problem that farmers' compensation rights cannot be realized in land requisition is quite serious. Therefore, the research on the realization of peasants' compensation right in land expropriation is a very important subject. The pace of land requisition in our country is quickened, and the rights of peasants who have been expropriated are difficult to guarantee, which is extremely disadvantageous to the socialist construction and the development of agriculture in our country. It is easy to lead to new social contradictions and conflicts. In the current legal system of our country, when the farmers' rights are infringed in the process of land expropriation, it is difficult to find the law and the unimpeded relief way to protect their compensation right, which makes the peasants' compensation right not realized. This is not conducive to the stability and development of a socialist society ruled by law and the construction of a harmonious society. In view of the situation that the compensation right of the peasants who have been expropriated is difficult to realize, this paper analyzes the problems deeply, and puts forward the corresponding measures, including the establishment of the peasants' right to refuse land requisition, the right of the peasants to evaluate and negotiate the price, the right to propose disputes that do not affect the compensation. The right to institute administrative proceedings. By perfecting the legal rights of the peasants who have been expropriated, and legally guaranteeing the compensation rights of the peasants who have been expropriated, the problems and unfair treatment that the compensation rights of the peasants cannot be realized in the process of land requisition can be solved.
