行政执法类公务员能力素质模型建设研究

【摘要】：2003年11月,国家人事部颁布了《国家公务员通用能力标准框架(试行)》,九项基本能力中有一项依法行政能力,要求公务员要有较强的法律意识、规则意识、法制观念；忠实遵守宪法、法律和法规；依法办事,敢于同违法行为做斗争。2006年1月1日起施行的《中华人民共和国公务员法》明确界定了行政执法类公务员的范围,即行政机关中直接履行监管、处罚、稽查等现场执法职责的公务员。由于行政执法类公务员在公务员招考中数量比较大,在社会基层一线工作,直接面对相关公众和行政执法相对人,因此对其执行国家有关政策法律的能力素质要求高,需要严把“入口关”,确保报考行政执法类公务员的人员基本能力素质符合标准,达到要求。目前,国内针对行政执法类公务员的能力素质标准的实践与研究尚属空白,特别是在定量研究领域,因此探索该类公务员的能力素质标准具有重要的现实意义。本文将研究对象定位于行政执法类公务员,分别采用文献研究总结概述、法律法规归纳总结、素质模型逐级构建、理论成果实际应用等模块进行综合研究。本文首先通过文献搜索及相关著作阅读对目前国内外公务员素质理论进行归纳总结,确定文章的整体行文脉络、思维框架；其次借鉴全国范围内已经试点并且发展相对成熟地区的先进模式,针对安徽省省情,结合座谈会和专家访谈讨论的结果,对能力素质进行维度分析,最终确定问卷调查的5个维度和49个素质要素,设计调查问卷；再次将知识能力、通用能力、执法能力、品德素质、身心素质等5个维度的49个素质要素,以此作为原始变量,把被调查者所填写的重要性及现状满意度等评定数据作为样本数据,采用SPSS软件实施探索性研究,最终确定行政执法类公务员的能力素质体系；最后以构建的行政执法类公务员能力素质模型为标准,针对行政执法类公务员招聘录用、人事测评、绩效考核等方面提出了建设性意见。
[Abstract]:In November 2003, the Ministry of personnel promulgated the "National Civil servant General competence Standard Framework (trial)", one of the nine basic competencies is the ability to administer according to law, which requires civil servants to have a strong sense of law, a sense of rules and a concept of legal system; Faithfully abide by the Constitution, laws and regulations, act according to law and dare to fight against illegal acts. The Civil servants Law of the people's Republic of China, which came into force on January 1, 2006, clearly defines the scope of civil servants in the category of administrative law enforcement. Administrative organs directly perform supervision, punishment, inspection and other field law enforcement duties of civil servants. Because of the large number of civil servants in the category of administrative law enforcement, who work at the grass-roots level of society and directly face the relevant public and administrative law enforcement counterparts, the quality of their ability to carry out the relevant policies and laws of the state is high. It is necessary to strictly control the entrance to ensure that the basic competence and quality of civil servants applying for administrative law enforcement meet the standard and meet the requirements. At present, the practice and research on the competence standards of civil servants of administrative law enforcement in China is still blank, especially in the field of quantitative research, so it is of great practical significance to explore the competence standards of this kind of civil servants. In this paper, the research object is located in the civil servants of the administrative law enforcement category, respectively, the literature research summary, the laws and regulations summary, the quality model construction step by step, the theory achievement actual application module carries on the comprehensive research. Firstly, this paper summarizes the theory of the quality of civil servants at home and abroad through literature search and related reading, and determines the overall line of writing, thinking frame; Secondly, drawing lessons from the advanced models of relatively mature regions and pilot projects in the whole country, aiming at the situation of Anhui Province, combining the results of the forum and expert interviews, the paper analyzes the dimension of ability quality. Finally determine the questionnaire of 5 dimensions and 49 quality elements, design the questionnaire; again, the knowledge ability, general ability, law enforcement ability, moral quality, physical and mental quality and other five dimensions of 49 quality elements, as the original variable, Taking the evaluation data of the importance and satisfaction of the survey as the sample data, using SPSS software to carry out exploratory research, finally determine the ability and quality system of the civil servants of administrative law enforcement; Finally, according to the model of ability and quality of civil servants of administrative law enforcement, this paper puts forward some constructive suggestions on the recruitment, personnel evaluation and performance evaluation of civil servants of administrative law enforcement.
