温州市非法行医监管问题研究

【摘要】：打击非法行医行为,是保持医疗卫生事业稳定健康发展的需要,是保障广大人民群众生命安全和健康的需要,是构建和谐医患关系,促进社会和谐稳定的需要。近年来,温州各级卫生行政部门整顿医疗市场秩序,打击非法行医的力度都在不断加强,但是非法行医现象还是屡禁不止。非法行医不仅危及到人民群众的生命、健康安全,还扰乱了医疗卫生市场秩序。如何有效的治理非法行医,一直是困扰着卫生行政部门的一个大难题。本文通过借鉴国、内外前人对非法行医研究的基础上,运用文献研究、现场调查、定性深入访谈、资料处理与分析等研究方法,通过对温州市2012年非法行医状况及2008年至2012年五年非法行医状况的变化等研究分析,结果显示温州市非法行医案件数最多的为鹿城区和瓯海区,非法行医主要以无证行医为主,主要分布区域为人口聚集的城郊集合部,涉及科目以内科为主,近五年非法行医总体趋势有所下降,但是2012年有所上升趋势,表明温州市非法行医形势不容乐观。结合对温州市非法行医现状的研究,分析并找出温州市非法行医存在的原因主要有医疗卫生行政法律法规滞后、医疗市场监管力量薄弱、医疗准入门槛存在的问题、医学毕业生的就业问题、赤脚医生等历史遗留问题等制度层面方面的原因,也有医疗资源分配不均衡、医疗保险覆盖面不广、非法行医的形式符合部分群众需求、部分群众对非法行医危害认识不足、非法行医者利益驱使等社会经济方面的原因,以及非法行医日趋隐蔽、非法行医成本低廉,卫生执法成本过高等原因。在明确了非法行医的执法过程中的薄弱环节,并尝试对温州市非法行医监管的路径进行分析,为加强对非法行医监管提供决策依据。
[Abstract]:To crack down on illegal medical practice is the need to maintain the stable and healthy development of medical and health care, to ensure the safety and health of the people's lives, to build a harmonious doctor-patient relationship and to promote social harmony and stability. In recent years, the health administrative departments at all levels in Wenzhou have strengthened their efforts to rectify the order of medical market and crack down on illegal practice of medicine, but the phenomenon of illegal practice of medicine is still prohibited. Illegal practice of medicine not only endangers people's life, health and safety, but also disturbs the order of medical and health market. How to effectively control illegal practice of medicine, has been a major problem puzzling the health administration. Based on the study of illegal medical practice in China and abroad, this paper uses the methods of literature research, field investigation, qualitative and in-depth interviews, data processing and analysis, etc. Through the analysis of the situation of illegal medical practice in Wenzhou in 2012 and the change of illegal practice in five years from 2008 to 2012, the results showed that the most cases of illegal practice in Wenzhou were Lucheng District and Ouhai District, and the main illegal medical practice was unlicensed practice. The main distribution area is the gathering part of the suburbs where the population is concentrated and the subjects involved are mainly internal medicine. The general trend of illegal practice of medicine in the past five years has declined, but the trend has increased in 2012, which indicates that the situation of illegal practice of medicine in Wenzhou is not optimistic. Based on the research on the status quo of illegal medical practice in Wenzhou, the main reasons for the illegal practice of medicine in Wenzhou are the lag of administrative laws and regulations of medical care and health care, the weak supervision of medical market, and the problems of the threshold of medical access. The reasons for the employment problems of medical graduates, the problems left over by history, such as barefoot doctors, and so on, are also due to the imbalance in the distribution of medical resources, the limited coverage of medical insurance, and the illegal practice of medicine in accordance with the needs of some people. Some people have insufficient understanding of the harm of illegal practice of medicine, the interests of illegal practitioners and other social and economic reasons, as well as illegal medical practice is becoming covert, illegal practice of low cost, too high cost of health enforcement, and so on. In this paper, the weak links in the law enforcement process of illegal practice of medicine are clarified, and the path of illegal medical practice supervision in Wenzhou City is analyzed, which provides a basis for decision making in strengthening the supervision of illegal practice of medicine.
