我国宅基地制度变革的道路选择与反思

【摘要】：宅基地使用权改革一直是人们关注的热点话题。为破解宅基地的粗放利用和闲置难题,理论界开出的药方高度趋同,即希望通过一系列法律和政策建构起物权化的宅基地制度,为推动宅基地交易创造条件,其实质是权利产权命题。高度市场化的改革话语忽视了宅基地制度的体制面向,有悖于作为地方性知识的地权制度安排,会造成严重的社会后果。基于法社会学的视角,宅基地制度的改革不宜走高度市场化路径,应该在改革试点中慎重推进。
[Abstract]:The reform of homestead use right has always been a hot topic that people pay attention to. In order to solve the problem of extensive utilization and idle of the homestead, the prescriptions of the theoretical circle are highly convergent, that is, the author hopes to construct the real right homestead system through a series of laws and policies, and to create the conditions for promoting the homestead trade. Its essence is the proposition of right and property right. The highly market-oriented reform discourse ignores the institutional orientation of the homestead system and runs counter to the arrangement of the land ownership system as a local knowledge, which will result in serious social consequences. Based on the perspective of sociology of law, the reform of the homestead system should not take a highly market-oriented approach, but should be carefully promoted in the pilot reform.
