公共资源交易综合行政执法改革的合法性分析——以合肥市公共资源交易综合行政执法改革为例

【摘要】：公共资源交易领域综合行政执法的变革正在全国如火如荼进行,然而却存在着变革的合法性危机。遵循法律程序的要件,同时符合法律授权的内容,是变革的前提和基础。"该得到法律授权的不能超前推进","要协调推进改革"是公共资源交易领域综合行政执法改革必须遵照的原则。合肥市以立法形式大胆创新公共资源执法体制,值得肯定,但也要得到法律的特别授权。各地政府应充分考虑各自实际情况,合法有序推进公共资源交易综合行政执法改革。
[Abstract]:The reform of comprehensive administrative law enforcement in the field of public resource transaction is in full swing all over the country, but there is a crisis of legitimacy of the reform. Compliance with the elements of legal procedure and with the content of legal authorization is the prerequisite and basis for change. " It is the principle that the comprehensive administrative law enforcement reform in the field of public resource transaction must be carried out according to the principle of "to coordinate and push forward the reform". Hefei innovates the law enforcement system of public resources in the form of legislation, which is worthy of recognition, but it also needs special authorization from the law. Local governments should give full consideration to their actual conditions and promote the reform of comprehensive administrative law enforcement of public resource transactions legally and in an orderly manner.
