“双学位”的合法性探析

【摘要】：福建"双学位风波"和武汉大学"双学位"案,引发了社会舆论对"双学位"合法性的广泛关注。由于高等教育相关立法的缺失和高校对学位授予权认识的滞后,"双学位"的合法性以及司法救济途径一直存有争议。在剖析双学位法律性质的基础上,通过比对双学位与第二学位的区别,提出了认可高校授予学位办学自主权,确立学校学位制度,合理解决双学位合法性问题的建议。
[Abstract]:The case of double degrees in Fujian Province and Wuhan University has aroused widespread concern about the legitimacy of double degrees. Due to the lack of legislation related to higher education and the lagging understanding of the right to grant degrees in colleges and universities, the legitimacy of "double degrees" and the way of judicial relief have always been controversial. On the basis of analyzing the legal nature of double degree and comparing the difference between double degree and the second degree, this paper puts forward some suggestions to recognize the autonomy of university to grant degree, to establish the system of university degree, and to solve the problem of legitimacy of double degree reasonably.
