城市规划中土地利用的法律规制——基于公平正义的分析

【摘要】：城市规划中土地利用制度的价值要求包含“公平”和“正义”两方面内容。具体而言,“正义”意在为公共政策提供价值导向和标准,“公平”则力求纠正公共决策带来的物质与非物质利益分配失衡,而具体法律规范的作用是在上述理念的要求下对于城市规划行为进行具体规制。需要依据城市规划中土地利用的特性,对于其范畴内“正义”的原则和标准问题进行讨论;阐释在“公平”的要求下,城市规划需要如何平衡多种利益。研究土地利用法律如何将规划正义中的基本原则具体化,在规划运行过程中规范各主体的行为,并对于出现的不公进行纠偏和补救,对于解决我国城市规划实践中出现的问题具有重要意义。
[Abstract]:The value of land use system in urban planning includes two aspects: equity and justice. In particular, "justice" is intended to provide value orientation and standards for public policy, while "equity" seeks to correct the imbalance between material and non-material benefits resulting from public decision-making. The function of the specific legal norms is to regulate the urban planning behavior under the requirements of the above ideas. According to the characteristics of land use in urban planning, this paper discusses the principles and standards of "justice" in urban planning, and explains how urban planning needs to balance various interests under the requirement of "equity". This paper studies how to concretize the basic principles of planning justice in land use law, standardize the behavior of various subjects in the course of planning operation, and correct and remedy the injustices that appear. It is of great significance to solve the problems in the practice of urban planning in China.
