我国民间中医生执业状态的制度伦理研究

【摘要】：民间中医生群体是我国卫生医疗事业中不可忽略的群体,但是现在民间中医生的执业状态不容乐观。具体体现在:拥有合法执业资格的民间中医生人数远远不能满足广大人民群众日益增长的医疗保健需求、民间中医生因为无法取得合法的执业资格导致大量非法的行医现象存在,这既给监管带来困难和权利寻租的空间,又使得大量民间中医生无法在阳光下行医,经济收益不稳定,内心无比自卑,因此很多民间中医生最后都转行另寻其他的发展道路、民间中医生在开办中医诊所时遇到很多政策阻力,使得中医诊所无法普及到广大的基层群众,或者使得很多中医诊所处于非法营运的状态。之所以产生这种不容乐观的现状,主要原因是长期以来针对民间中医生执业的相关制度存在诸多不完善、不合理。制度的不合理容易把执行制度者和制度实施对象都引导到不道义的方向,这不仅使得制度想要达到的目的无法实现,而且容易引发整个行业的制度性道德崩塌,这对整个行业的发展都会产生不良的影响。通过从制度伦理的角度对我国民间中医生执业状态进行研究,发现要想突破现在民间中医药事业发展的困局,就必须从制度伦理的角度对民间中医生执业制度进行改革。在制度设计的主体、对象和执行三个方面要充分考虑到中医本身的发展规律和民情国情,包括地区差异性,更特别要关注制度设计所带来的民间中医生行医的临床有效性和便利性。民间中医生的执业制度在现阶段更多要以鼓励和开放为主,在坚守真诚的最基本底线的前提下,让监管更多起到引导作用,而尽可能少一些强迫性措施。随着首部《中医药法》的即将出台,本文对如何改革民间中医生现行的执业制度,使民间中医生能够更好地为广大人民群众的健康服务或有一定的启发意义。
[Abstract]:The community of doctors is a group that can not be ignored in the field of health care in our country, but the practice status of doctors in the civil society is not optimistic. Specifically, the number of doctors among the people with legal qualifications is far from being able to meet the growing medical and health needs of the broad masses of the people. Due to the fact that doctors in the civil society are unable to obtain legal qualifications for practicing medicine, a large number of illegal medical practices exist, which not only brings difficulties to supervision and room for rent-seeking, but also makes a large number of doctors in the private sector unable to practise medicine in the sun, resulting in unstable economic benefits. Because of the inferiority complex in the heart, many doctors in the private sector ended up looking for other ways of development. Doctors in the private sector encountered a lot of policy obstacles in setting up Chinese medicine clinics, which prevented them from reaching the broad masses of grassroots people. Or make many TCM clinics in the state of illegal operation. The main reason for this unoptimistic situation is that there are many imperfections and unreasonableness in the related system of practicing doctors in the civil society for a long time. The irrationality of the system can easily lead the executor and the object of the system to the direction of immorality, which not only makes the purpose of the system impossible to achieve, but also easily leads to the collapse of the institutional morality of the whole industry. This will have a negative impact on the development of the entire industry. Through the research on the medical practice status of Chinese folk doctors from the point of view of institutional ethics, it is found that in order to break through the difficulties of the development of folk Chinese medicine, we must reform the medical practice system of folk doctors from the perspective of institutional ethics. In the three aspects of system design, including the main body, the object and the implementation, we should fully take into account the law of development of TCM itself and the national conditions of the people, including regional differences. We should pay more attention to the clinical effectiveness and convenience brought by the system design. At the present stage, the practice system of doctors in the civil society should be more encouraged and open. Under the premise of sticking to the most basic bottom line of sincerity, more supervision should play a leading role, and there are as few coercive measures as possible. With the coming out of the first "Chinese Medicine Law", this paper has some enlightening significance on how to reform the current practice system of doctors in the civil society and enable them to better serve the health of the broad masses of the people.
