我国地方政府“弃风限电”的法律规制研究

【摘要】：严重制约风电产业发展并阻碍能源结构转型的"弃风限电"现象近年在我国愈演愈烈,其主要成因在于地方政府对电力行业的不当干预及现行法律制度不能规制这些不当干预。文章认为只有通过立法确立可再生能源对不可再生能源的"替代"地位,构建严格限制火电行业发展的规则、构建具体的地方政府编制用电计划应预先安排可再生能源发电量的操作规则及程序,才能为有效规制地方政府非因技术原因的"弃风限电"现象奠定制度基础。
[Abstract]:The phenomenon of "abandon wind and limit power", which seriously restricts the development of wind power industry and hinders the transformation of energy structure, has become more and more serious in China in recent years. The main cause of this phenomenon lies in the improper intervention of local governments in the electric power industry and the inability of the current legal system to regulate these improper interventions. This paper holds that only by legislation to establish the status of "substitution" of renewable energy to non-renewable energy, the rules of strictly restricting the development of thermal power industry should be established. In order to set up a specific local government's electricity consumption plan, the operational rules and procedures of renewable energy generation should be arranged in advance, so as to lay a system foundation for the effective regulation of local government's "abandon wind and limit electricity" phenomenon, which is not due to technical reasons.
