应加快推进《土地管理法》新一轮修改完善工作——推进依宪修改完善《土地管理法》专题研究座谈会综述

【摘要】：研究目的:归纳总结"推进依宪修改完善《土地管理法》专题研究座谈会"的重要观点,为《土地管理法》修改提供建议和参考。研究方法:综述分析。研究结果:现行《土地管理法》存在着一定的历史局限性,并与相关法律存在交叉和冲突;在当前社会经济发展新常态下,《土地管理法》修改应顶层设计先行,明确其立法性质和定位,确定立法目的与任务,对具体条款进行修改和完善,并与其他相关法律协调统一。研究结论:《土地管理法》中的土地权利体系需要进一步明确和完善;集体土地所有权的主体、权能、界定、行使等相关问题需进一步明确,防止被弱化;宅基地使用权的修改需要统筹兼顾、分类设计,对具体环节规定进行完善;集体经营性建设用地的修改需要建立利益调节机制,规范流转环节;土地征收补偿的立法修改应当从立法定位、权利划定、补偿标准等方面建立系统的修改方案。
[Abstract]:The purpose of this paper is to summarize the important viewpoints of the Symposium on promoting the improvement of the Land Management Law in accordance with the Constitution, and to provide suggestions and references for the revision of the Land Management Law. Methods: review and analysis. The research results show that the present Land Management Law has some historical limitations, and there is a cross and conflict with the relevant laws, and under the new normal condition of the current social and economic development, the revision of the Land Management Law should be preceded by the top-level design. It clarifies its legislative nature and position, determines the legislative purpose and task, modifies and perfects the specific provisions, and harmonizes and unifies with other relevant laws. Research conclusion: the land right system in the Land Management Law needs to be further clarified and perfected, the subject, power, definition and exercise of collective land ownership need to be further clarified to prevent weakening. The modification of the right to use the homestead needs to be integrated, classified and designed, and the regulation of the specific links should be perfected, and the modification of the land for collective use of construction needs to establish a mechanism for regulating the interests of the land, and to standardize the circulation of the land; The legislative revision of land expropriation compensation should be systematically revised from the aspects of legislative orientation, right delineation, compensation standard and so on.
