师生关系视野下维护教师权利和学生权利的协同创新策略

【摘要】：明晰和维护师生权利是推进依法治教的核心议题。我国宪法和教育法律关于教师权利和学生权利的规定开启了依法维护师生权益的法律渠道,但是在师道尊严传统、集权管理模式、以教师为中心的学校文化的约束下,以法制为基础、以学生为本位的新型师生关系仍然难以构筑。现代社会的发展要求师生权利关系的根本性变革,从注重教师权利的单向维护向注重师生权利的双向维护转变,从教师的指导权为本向学生的表现展示权为本的转变,从"以教代学"的师生权利结构向"以学立教"的师生权利结构转变。为构筑新型师生关系,必须在维护教师的教育教学实施权与学生的教育教学参与权、维护教师的指导学生权和学生的自主学习权、维护教师的评价权和学生的自我评价权三个方面采取一系列的创新策略。
[Abstract]:Clarifying and safeguarding the rights of teachers and students is the core issue of promoting the administration of education according to law. The provisions of the Constitution and the education law on teachers' rights and students' rights open the legal channels to safeguard the rights and interests of teachers and students according to law. However, under the constraints of the tradition of teachers' dignity, the centralized management mode and the teacher-centered school culture, The new teacher-student relationship based on legal system and student-centered is still difficult to construct. The development of modern society requires the fundamental change of the relationship between teachers and students' rights, from the one-way protection of teachers' rights to the two-way maintenance of teachers' and students' rights, from the teachers' guiding right to the students' right to show their performance. From the teacher-student right structure of "teaching instead of learning" to the structure of teacher-student right of "teaching by learning". In order to build a new relationship between teachers and students, we must safeguard teachers' right to implement education and teaching, students' right to participate in education and teaching, teachers' right to guide students and students' right to learn independently. A series of innovative strategies are adopted to maintain teachers' right of evaluation and students' right of self-evaluation.
