公共文化服务保障法的制度构建与实现路径

【摘要】：[目的 /意义]解析《中华人民共和国公共文化服务保障法》所建立的公共文化服务基本制度,为贯彻落实基本制度和建立完善实施细则、配套规章提供指引。[方法 /过程]将该法所建立的我国公共文化服务基本制度梳理总结为基础性制度、针对性制度、政府监管制度和机构责任制度4类,并具体分析主要制度的提出背景、构成要素、内容要求、主要特点及制度落实应突破的主要问题等。[结果 /结论]《中华人民共和国公共文化服务保障法》建立的基本制度有的是将经过长期实践发展成熟的政策上升为法律制度,有的是对现行法规政策的完善或发展,有的是对基层公共文化服务创新实践的总结提炼,也有借鉴国际经验、结合中国现实的制度设计。法律构筑起了我国公共文化服务的基本制度体系框架。
[Abstract]:Objective / significance: to analyze the basic system of public cultural service established by the Law of the people's Republic of China on the guarantee of Public Cultural Services, and to provide guidance for the implementation of the basic system and the establishment and improvement of the detailed rules and regulations for the implementation of the basic system. [method / process] the basic system of public cultural service established by this law is summarized into four categories: basic system, targeted system, government supervision system and institutional responsibility system, and the background of the main system is analyzed concretely. Elements, content requirements, main characteristics and system implementation should break through the main problems. [results / conclusion] the basic system established by the Law of the people's Republic of China on the guarantee of Public Cultural Services has some policies developed and developed over a long period of time into a legal system, and some have improved or developed the existing laws and regulations. Some summarize and refine the innovation practice of grass-roots public cultural service, and also draw lessons from international experience and combine the system design of China's reality. The law has constructed the basic system frame of our country public culture service.
