农村土地承包经营权转让制度研究

【摘要】：自古以来,农村问题尤其是农村土地问题是统治者治理社会的关键性问题。新中国成立以来,农村土地制度特别是农村土地承包经营权转让制度的建立和完善经历了多次的改革,制定了大量的法律法规,促进了农村生产力的巨大发展。然而进入新世纪以来,随着发展脚步的加快,现有法律规定的农村土地转让制度已经不适合眼下的实际状况。它不仅不能满足农村生产力的发展,还造成了土地资源的严重浪费、农民收入增加幅度有限以及农村经济发展面临困境等问题。鉴于此,本文通过分析现有农村土地承包经营权转让制度存在的问题,以期提出完善我国农村土地转让制度的建议。本文共分为四个部分,具体如下：第一部分,对农村土地承包经营权转让制度的相关理论进行了深刻的阐述。主要包括土地承包经营权转让的概念和特征、土地相关理论、转让制度的法理分析及转让的必要性等,为后面的论述奠定理论基础。第二部分,主要分析了我国农村土地承包经营权转让制度的现状及其在实践中出现的问题及成因,为文章最后提出完善建议做准备。首先,转让制度的现状包括法律法规的现行规定和农村土地承包经营权转让制度的运行现状；其次对农村土地承包经营权转让制度存在的问题及其成因进行了分析。第三部分,本部分主要简单地介绍了域外国家关于土地的相关制度。主要包括分析大陆法系的德国和日本、英美法系的美国和英国等国家的土地制度,总结国外先进经验,为提出完善我国农村土地承包经营权转让制度提供参考,以期借鉴。第四部分,本文最为关键的部分,对完善我国农村土地承包经营权转让制度提出完善建议。通过前面几个部分的基本概念、相关理论、现状、存在问题及成因的分析和域外先进经验的总结,笔者提出了完善我国农村土地承包经营权转让的建议,以期对农村土地制度的改革完善有所助益。
[Abstract]:Since ancient times, the rural problem, especially the rural land problem, is the key problem for the rulers to govern the society. Since the founding of the people's Republic of China, the establishment and perfection of the rural land system, especially the transfer system of the contracted management right of rural land, has undergone many reforms, formulated a large number of laws and regulations, and promoted the great development of the rural productive forces. However, in the new century, with the acceleration of the pace of development, the current legal system of rural land transfer is no longer suitable for the actual situation. It not only can not satisfy the development of rural productive forces, but also causes serious waste of land resources, limited increase of farmers' income and difficulties in the development of rural economy. In view of this, this paper analyzes the existing problems in the transfer system of rural land contractual management right, in order to put forward suggestions to improve the rural land transfer system in China. This paper is divided into four parts, as follows: the first part, the transfer system of rural land contractual management rights theory is deeply expounded. It mainly includes the concept and characteristics of the transfer of land contractual management right, the related theories of land, the legal analysis of the transfer system and the necessity of the transfer, which lays a theoretical foundation for the following discussion. The second part mainly analyzes the present situation of the transfer system of rural land contractual management right in our country and the problems and causes in practice, and makes preparations for the perfection of the article. First of all, the present situation of the transfer system includes the current provisions of laws and regulations and the operation status of the rural land contractual management right transfer system; secondly, the problems existing in the transfer system of rural land contractual management right and its causes are analyzed. The third part, this part mainly introduces the foreign countries about the land related system. It mainly includes analyzing the land systems of Germany and Japan in the continental law system, the United States and the United Kingdom in the Anglo-American law system, summing up the advanced experience of foreign countries, and providing a reference for improving the transfer system of the contracted management right of rural land in our country. The fourth part, the most important part of this paper, puts forward some suggestions to perfect the transfer system of rural land contractual management right. Based on the analysis of the basic concepts, relevant theories, current situation, existing problems and causes of the above parts and the summary of the advanced experiences in the foreign countries, the author puts forward some suggestions on how to improve the transfer of the contracted management right of rural land in China. With a view to rural land system reform and improvement has been helpful.
