限制出境适用探析

【摘要】：作为出入境管理的重要制度，限制出境制度对公民的出境有着决定性影响。随着对外交往的不断紧密，公民出境事由日趋多元化，便利往来需求日益凸显，限制出境制度逐渐受到公民的关注。我国出入境管理从无到有经历数次飞跃发展，不乏突破和创新，呈现出许多特点、亮点，但限制出境制度的变革并不大。通过考察限制出境制度的现状，发现在主体、程序、救济等方面的缺失，公民的出境自由没有得到应有的保护，也极易因不适当的限制措施对其他权利造成不必要的侵害。为了充分发挥限制出境制度的正当性作用，在权限、程序设置、法律责任等方面进行制度完善，，吸收借鉴先进经验，从而建立起正当、高效、完善的限制出境制度。
[Abstract]:As an important system of entry and exit management, the restriction system has a decisive effect on the exit of citizens. With the continuous close contact with foreign countries, the reasons for citizens leaving the country are becoming more and more diversified, the demand for convenience is becoming increasingly prominent, and the system of limiting exit gradually attracts the attention of citizens. China's entry and exit management has experienced several leaps and bounds from scratch, without lack of breakthroughs and innovations, showing many characteristics and bright spots, but the reform of the system of limiting exit is not great. By examining the current situation of the restriction system, we find that the lack of subject, procedure, relief and so on, the citizen's freedom of exit has not been protected properly, and it is easy to cause unnecessary infringement on other rights because of improper restriction measures. In order to give full play to the legitimate role of the restriction system, the system should be perfected in the aspects of authority, procedure setting, legal responsibility and so on, so as to establish a proper, efficient and perfect restrictive exit system.
