医疗服务商标法律保护的实证研究

【摘要】:随着入世后国内医疗市场准入限制的放宽和境外医疗资源的逐步进入,国内医院的服务品质与市场份额将面临新的挑战和竞争。在这一进程中,医院标志的商标化必将成为医院内涵与外延建设中无形资产的重要保护措施,也是医院品牌建设的重要法律保障。本文首先提出了医疗服务商标的基本理论,同时与红十字标志、医疗标志、医疗机构名称、医疗品牌等其他相关概念进行了辨析。商标是能将自己的商品或服务与他人的商品和服务区分开的标志。根据商品的有形与无形,,商标可以分为商品商标、服务商标两种。医院所提供的商品是医疗服务,是一种无形的商品。因此,结合商标的定义,医疗服务商标可定义为注册后将不同医疗机构所提供的医疗服务相区别开来的一种受法律保护的标记,它属于服务商标。我国商标取得的模式是注册取得,是指特定人就某一特定且具有显著性的标识向有关机关申请注册并被核准的,则这一申请人无需对该标识进行使用即可获得相关商标权,并受商标法的保护。但是,在具体的执行中,医疗服务商标存在着很多的问题。本文采用实证研究的方法,搜集我国医疗服务商标注册的信息并对其进行数据统计分析,然后查阅相关法律,并结合当今医疗商标的使用现状,认为在目前我国商标以注册取得的模式下,存在的突出问题主要有三个:(1)医疗服务商标在先使用普遍存在。(2)医疗服务商标与医疗机构名称存在着冲突。(3)医疗服务商标往往会被抢注。论文的最后一部分,本研究分析了国际上关于服务商标保护的公约和示范法条,考察在相关问题上可以借鉴的经验,并在分析我国商标立法问题的基础上,提出了针对医疗服务商标的法律保护建议:明确未注册医疗服务商标的法律地位,完善《反不正当竞争法》中有关医疗服务商标的规定,明确有关医疗机构名称权的规定并改革现有的医疗机构名称登记制度,以及医疗服务商标权的合理限制。
[Abstract]:With the relaxation of domestic medical market access restrictions and the gradual entry of overseas medical resources, the service quality and market share of domestic hospitals will face new challenges and competition. In this process, the trademark of hospital logo will become an important protection measure of intangible assets in hospital connotation and extension construction, and also an important legal guarantee of hospital brand construction. This paper first puts forward the basic theory of medical service trademark, at the same time discriminates with other related concepts such as Red Cross logo, name of medical institution, medical brand and so on. A trademark is a mark that distinguishes one's goods or services from those of others. According to the tangible and intangible goods, trademarks can be divided into commodity trademarks and service trademarks. What the hospital provides is a medical service, is an invisible commodity. Therefore, combined with the definition of trademark, the trademark of medical services can be defined as a legally protected mark that distinguishes the medical services provided by different medical institutions after registration, and it belongs to the trademark of services. The mode of trademark acquisition in China is registration, which means that a particular person applies to the relevant authorities for registration and approval of a specific and significant mark, and the applicant can obtain the relevant trademark right without using the mark. And protected by the Trademark Law. However, in the specific implementation of the medical service trademark there are many problems. This paper adopts the method of empirical research to collect the information of the trademark registration of medical services in China and make statistical analysis of the data, and then consult the relevant laws, and combine with the current situation of the use of medical trademarks. Under the current mode of trademark registration in China, There are three outstanding problems: (1) the prevalence of medical service trademark before use; (2) the conflict between the medical service trademark and the name of medical institution; (3) the medical service trademark will often be preempted. In the last part of the thesis, the author analyzes the international conventions and model laws on the protection of service trademarks, examines the experience that can be used for reference on relevant issues, and analyzes the problems of trademark legislation in China. This paper puts forward some suggestions for the legal protection of medical service trademark: clarifying the legal status of the unregistered medical service trademark, perfecting the provisions of the Anti-unfair Competition Law concerning the medical service trademark, It is clear about the regulation of medical institution name right and reform the existing medical institution name registration system, as well as the reasonable restriction of medical service trademark right.
