我国公共租赁住房物业管理法律研究

【摘要】:我国公共租赁住房物业管理法律制度与普通商品房物业管理制度既有共性,亦带有鲜明的个性特征。公共租赁住房制度的发展呼唤着一个完善的物业管理制度,但当前我国公共租赁住房物业管理制度却存在诸多问题,核心问题是政府、承租人与物业管理企业的权利边界确定和承租人物业管理权利与义务的重构,是坚持行政主导、承租人自治还是实行完全的市场化?承租人自治机制如何设计,能否成立类似于业主委员会性质的承租人委员会? 对公共租赁住房物业管理制度的特殊性认识不到位,对其理论基础研究不足,,进而导致立法的滞后,这是当前公共租赁住房物业管理制度诸多问题产生的原因,所以,破解这一理论难题亦是公共租赁住房物业管理制度构建的前提和基础。 忽视市场机制、完全依靠国家行政手段实施公共租赁住房物业管理是无效率和不可持续的;但同时,把公共租赁住房物业管理完全交给市场来调节,政府职能缺位同样会使问题得不到彻底解决。因此,通过对相对所有权等理论的考察,文章初步为赋予承租人有限物业管理权找到了理论支撑,进而又着重分析了政府、物业管理企业、承租人三方法律主体之间权利、义务与职责的边界,将政府定位于“加强宏观调控,承担社会管理职能,购买社会服务”的角色;通过公开选聘,由物业管理企业提供专业化的物业服务;同时又赋予承租人有限的自我管理权,最终实现公共租赁住房物业管理准市场化模式。
[Abstract]:The legal system of property management of public rental housing in our country and the real estate management system of ordinary commercial housing have both commonness and distinctive characteristics. The development of public rental housing system calls for a perfect property management system. However, at present, there are many problems in the property management system of public rental housing in China, the core of which is the government. The determination of the right boundary between the lessee and the property management enterprise and the reconstruction of the lessee's right and obligation of the property management should insist on the administrative leading, the lessee's autonomy or the complete marketization? How to design the mechanism of lessee autonomy and whether to set up a lessee committee similar to the owner's committee? The lack of understanding of the particularity of public rental housing property management system, the lack of research on its theoretical basis, and then lead to the lag of legislation, which is the reason of many problems in the current public rental housing property management system, so, Solving this theoretical problem is also the premise and foundation of the construction of public rental housing property management system. Ignoring the market mechanism and relying entirely on the state administrative means to implement public rental housing property management is inefficient and unsustainable, but at the same time, the management of public rental housing property management is completely regulated by the market. The absence of government functions will also leave the problem unsolved. Therefore, through the investigation of relative ownership and other theories, the article preliminarily finds theoretical support for giving the lessee limited property management right, and then focuses on the analysis of the rights between the three legal subjects: government, property management enterprise and lessee. The boundary between obligation and duty, the government is positioned to "strengthen macro-control, assume social management function, purchase social service" role, through open selection, by the property management enterprises to provide professional property services; At the same time, it gives the lessee limited right of self-management, and finally realizes the quasi-market mode of public rental housing management.
