土地管制权的理论基础

【摘要】：土地管制权的来源与土地利用的物理特性及土地所有制度有密切关系,该权力的来源决定了土地管制权力在本质上与公共利益有不可分割的关系,因此,土地管制权的理论基础就是公共利益。土地管制权中的公共利益具有自身的特点,这些特点决定了公共利益可以对土地管制权力进行一定的规制。规制的核心要素是判断土地管制中公共利益标准以及保证公益机制。
[Abstract]:The source of land control right is closely related to the physical characteristics of land use and the system of land ownership. The source of this power determines that the power of land control is intrinsically related to the public interest. The theoretical basis of land control right is public interest. The public interest in the land control right has its own characteristics, which determines that the public interest can regulate the land control power to a certain extent. The core element of regulation is to judge the standard of public interest in land control and to ensure public benefit mechanism.
