职责法定化是制定权力清单的前提

【摘要】：正政府职责法定化实质是政府权源合法性问题。只有政府权力来源于法律的明确规定,才是合法化的权力。党的十八届四中全会提出,要"依法全面履行政府职能。完善行政组织和行政程序法律制度,推进机构、职能、权限、程序、责任法定化。推行政府权力清单制度,坚决消除权力设租寻租空间"。那么,"推进机构、职能、权限、程序、责任法定化"与"推行政府权力清单制度"是怎样的关系呢?政府机构、职能等的法定化是政府制定权力清单的内在依据,权力清单是权力合法化的外在公开形式,制定权力清单的过程也是政府确权
[Abstract]:The legalization of government responsibility is essentially the legitimacy of the source of government power. Only when the power of the government originates from the explicit stipulation of the law, can it be legalized. The fourth Plenary session of the 18th CPC Central Committee proposed that the government function should be fully performed in accordance with the law. Perfect the legal system of administrative organization and administrative procedure, promote the legalization of organization, function, authority, procedure and responsibility. The implementation of the government power list system, resolutely eliminate the power of rent-seeking space. " So what is the relationship between "promoting the institution, function, authority, procedure, responsibility legalization" and "carrying out the government power list system"? The legalization of government agencies and functions is the internal basis for the government to make the list of powers. The list of powers is the external and open form of legalization of power, and the process of making the list of powers is also the process of confirming the power of the government.
