壮族语言文字立法刍议

【摘要】：目前,关于少数民族语言文字的立法保护问题,国内民族学家、法学研究者都有一些很有前瞻性的论述,对我国少数民族语言文字立法,特别是对西藏、新疆、内蒙古的少数民族语言文字立法都有相当丰富的研究。例如：郭友旭《语言权利的法理》、刘文、裴瑛《语言文字立法与民族问题》、王远新《我国少数民族语言文字立法的必要性》、吴双全《中国少数人权利法律保护的实践评析》肖剑飞《语言权利的立法表述及其相反概念》、周庆生《新疆的语言立法》、《西藏新疆语言立法比较》、周炜《西藏的语言文字立法》、《关于西藏自治区藏语文立法若干问题的思考关于西藏自治区藏语文立法若干问题的思考》、乌兰那日苏《我国少数民族语言文字权的立法保护》、包来福《试析我国少数民族语言文字的立法保护现状》等。《民族研究》、《广西民族研究》、中国民族宗教网等学术杂志和民族类网站都有一些对少数民族语言文字的探讨。有些国内学者还对外国少数民族语言文字立法保护进行研究,例如：柏树义《挪威《萨米语言法》与中国少数民族语言政策的比较分析》、周庆生《挪威的萨米语言立法》等。与国内少数民族语言文字立法研究形成鲜明对比的是,学者对壮语文的立法保护问题论及甚少,多是在各种少数民族语言文字立法保护著作中附带提及,较少有专著进行研究,研究极少。本文拟通过民族法学、民族教育学、多元文化教育、民族学等学科理论的基本原理与方法,在比较全面地分析壮族语言文字政策现状的基础上,并通过借鉴欧美国家少数民族语言文字立法及中国其他民族自治地方少数民族语言文字立法的有益经验,论证壮族语言文字立法保护的重要性,并提出壮语文立法保护的初步设想,指出壮语文立法保护的目的是全面提高壮语文的社会地位,将壮语文应用于现代社会的方方面面,促进壮语文适应现代社会的发展需要,从而促进壮民族的自身发展进步,为根本改变壮语文应用的落后状况,实现壮族语言文字跨越式发展,提供坚强有力的法律支撑和保障。全文共分五章。第一章是我国少数民族语言文字立法概况,描述宪法、其他部门法、地方性法规、规章、民族自治地方有关少数民族语言文字使用和发展的规定。第二章介绍了壮族语言文字概况及其使用现状。第三章分析壮族语言文字立法保护存在的问题及原因。第四章详细阐述壮族语言文字立法保护的必要性和重要性。第五章是壮族语言文字立法依据及初步构想。
[Abstract]:At present, with regard to the legislative protection of minority languages and characters, domestic ethnologists and legal researchers have some very forward-looking expositions, legislating on minority languages and characters in China, especially Tibet and Xinjiang, The legislation of minority languages and characters in Inner Mongolia has abundant research. For example: Guo Youxu, "Jurisprudence of language Rights", Liu Wen, Pei Ying, "legislation of language and character and ethnic problems", Wang Yuanxin, "the necessity of legislation of Minority languages and characters in China", Wu Shuangquan, "the practice of the legal Protection of Minority Rights in China" Xiao Jian, Fei, "Legislative expression of language Rights" Zhou Qingsheng, "language legislation in Xinjiang", "comparison of language legislation in Xinjiang," Zhou Wei, "Tibetan language legislation", "thinking about Tibetan language legislation in Tibet Autonomous region" Reflections on some problems in Chinese legislation. Wu Lan, the Soviet Union, "Legislative Protection of Minority languages and characters in China", Bao Laifu, "Analysis of the current situation of Legislative Protection of Minority languages and characters in China". "ethnic Studies", "Guangxi ethnic minorities" Research, China National Religion Network and other academic magazines and ethnic websites have some discussion on minority languages and characters. Some domestic scholars have also studied the legislative protection of foreign minority languages and characters, such as the comparative analysis of the Saami language Law of Norway and the policies of Chinese Minority languages, Zhou Qingsheng's Sami language legislation in Norway, and so on. In contrast to the study on legislation of minority languages and characters in China, scholars seldom discuss the issue of legislative protection of Zhuang language, most of which are mentioned incidentally in various works on legislative protection of minority languages and characters, and there are few monographs to study them. There is little research. Based on the basic principles and methods of the theories of ethnic law, ethnic pedagogy, multiculturalism education, ethnology and other disciplines, this paper analyzes the present situation of Zhuang's language and writing policies in a more comprehensive way. The importance of the legislative protection of Zhuang nationality language is demonstrated through the useful experience of the legislation of minority languages and characters in Europe and the United States and in other autonomous areas of China. It also puts forward the tentative idea of the legislative protection of Zhuang Chinese, and points out that the purpose of the legislative protection of Zhuang Chinese is to improve the social status of Zhuang Chinese in an all-round way, to apply Zhuang Chinese to all aspects of modern society, and to promote Zhuang Chinese to meet the needs of the development of modern society. In order to promote the development and progress of Zhuang nationality itself, to fundamentally change the backward situation of Zhuang language application, to realize the leap development of Zhuang language and characters, to provide strong and powerful legal support and guarantee. The full text is divided into five chapters. The first chapter is the general situation of the legislation of minority languages and characters in China, describing the constitution, other laws, local regulations, rules and regulations, and the provisions concerning the use and development of minority languages and characters in autonomous areas. The second chapter introduces the Zhuang language and its use. The third chapter analyzes the existing problems and causes of the protection of Zhuang language and characters. Chapter four elaborates the necessity and importance of the legislative protection of Zhuang language and characters. Chapter five is the legislative basis and preliminary conception of Zhuang language.
