法治视域下的行政强制拆迁制度研究

【摘要】：行政强制拆迁是政府及其职能部门在依法行政的过程中履行职能的重要组成部分,是在全面推进依法治国大背景下城市规划与新农村建设过程中的关键一环。为了使行政强制拆迁活动更加规范地进行,通过法治涵义、行政强制拆迁制度的内容、存在的意义、存在的问题以及完善的建议等方面入手对行政强制拆迁这一制度进行探析以求达到对行政强制拆迁制度追根溯源,捋清法律关系、正确理解和适用的目的。首先,阐述法治视域下的行政强制拆迁制度的相关理论,包括法治的相关理论、行政强制拆迁的内涵以及法治视域下的行政强制拆迁,为下文具体讨论做好铺垫。其次,论证行政强制拆迁制度存在的必要性。通过指出司法强制拆迁存在的问题,阐述行政强制拆迁存在的合理性并将上述两种制度进行对比,最终得出行政强制拆迁制度存在的必要性及意义。再次,分析行政强制拆迁制度存在的问题。从立法、实践两个层面对行政强制拆迁过程中存在的问题进行深入探析,揭示在此过程中存在的立法不完善、行政强制拆迁中的违法现象、国家及社会监督不力以及救济途径不畅通等问题。最后,提出完善行政强制拆迁制度的建议。针对存在的问题,结合实际提出立法、实践等方面的可行性建议。
[Abstract]:Administrative forced demolition is an important part of the government and its functional departments to perform their functions in the process of administration according to law. It is a key link in the process of urban planning and new rural construction under the background of comprehensively promoting the rule of law. In order to make the administrative forced demolition activities more standardized, through the meaning of the rule of law, the content of the administrative forced demolition system, the significance of existence, In order to trace the source of the administrative forced demolition system, clear up the legal relationship and correctly understand and apply it, the existing problems and perfect suggestions are analyzed in order to reach the goal of tracing back to the source of the administrative forced demolition system. First of all, the related theories of the administrative forced demolition system under the rule of law are expounded, including the related theory of the rule of law, the connotation of the administrative forced demolition and the administrative forced demolition under the rule of law, which pave the way for the concrete discussion below. Secondly, the necessity of administrative forced demolition system is demonstrated. By pointing out the problems existing in the judicial forced demolition, this paper expounds the rationality of the existence of the administrative forced demolition and compares the two systems above, and finally concludes the necessity and significance of the existence of the administrative forced demolition. Thirdly, it analyzes the problems existing in the system of administrative forced demolition. From the two aspects of legislation and practice, the problems existing in the process of administrative forced demolition are deeply analyzed, and the imperfect legislation and illegal phenomenon in the process of administrative forced demolition are revealed. State and social supervision is weak and relief channels are not smooth and so on. Finally, the paper puts forward some suggestions to perfect the system of administrative forced demolition. Aiming at the existing problems, this paper puts forward some feasible suggestions on legislation, practice and so on.
