民族文化产业法律保障的问题反思与完善路径——以甘肃省民族文化产业地方立法为例证

【摘要】：民族文化产业是文化产业的主要类型之一,其核心资源禀赋是民族文化。民族文化产业适用文化产业对法律保障的一般要求,民族文化的地域性、多样性、生态脆弱性、难以保护等特点也决定了其对法律保障的特殊要求。甘肃省民族文化资源丰富,但民族文化产业的发展却相对落后的现状要求更加科学完善的法律保障加以促进。本文在论证民族文化产业法律保障普适性要求的基础上,以甘肃省为例,具体分析了民族文化产业法律保障的现状与存在的问题,并就其完善提出了相关建议。
[Abstract]:National culture industry is one of the main types of cultural industry, and its core resource endowment is national culture. The special requirements of legal protection are also determined by the characteristics of national culture industry, such as the region, diversity, ecological fragility and difficulty of protection of the national culture industry, which is applicable to the general requirements of the legal protection of the cultural industry. Gansu Province is rich in national cultural resources, but the development of ethnic culture industry is relatively backward, which requires more scientific and perfect legal guarantee to promote it. On the basis of demonstrating the universal requirement of legal guarantee of ethnic culture industry, taking Gansu province as an example, this paper concretely analyzes the present situation and existing problems of legal guarantee of national cultural industry, and puts forward some relevant suggestions on its perfection.
