突发事件中政府信息公开制度研究

【摘要】：在现今社会中突发事件发生日益频繁,不仅关系到公众的生命财产安全,而且关系到社会的稳定和发展。我国是一个突发事件多发的国家,政府在突发事件应对过程中具有任何组织和个人都无法代替的作用和优势,而政府信息公开是政府有效应对突发事件的重要手段,所以加强对突发事件中政府信息公开制度的研究意义重大而深远。 完善突发事件中政府信息公开制度,保障公民的知情权,使遭受损害的民众获得救济和申述的渠道,监督政府行政行为的实施,为构建服务型政府奠定基础。文章共分为四个部分：第一部分介绍了突发事件中政府信息公开的基本理论,分析了突发事件中政府信息公开的理论基础和意义,以及政府在突发事件中信息公开应当遵循的特殊要求。第二部分对外国应对突发事件的管理机制进行考察,以及分析对我国突发事件中政府信息公开的借鉴和启示。第三部分着重分析了我国突发事件中政府信息公开制度存在的问题,主要对观念层面、法律体系层面和配套制度层面进行研究。第四部分针对我国存在的问题提出相关的建议和措施来完善我国突发事件中政府信息公开制度。
[Abstract]:In today's society, emergencies occur more and more frequently, which is not only related to the safety of public life and property, but also to the stability and development of society. China is a country prone to emergencies, the government has the role and advantage that any organization and individual can not replace in the emergency response process, and the government information disclosure is an important means for the government to deal with emergencies effectively. Therefore, it is of great significance to strengthen the research on the system of government information disclosure in emergencies. To perfect the system of government information disclosure, to protect the citizens' right to know, to make the injured people obtain relief and representation, to supervise the implementation of government administrative actions, and to lay the foundation for the construction of service-oriented government. The article is divided into four parts: the first part introduces the basic theory of government information disclosure in emergencies, analyzes the theoretical basis and significance of government information disclosure in emergencies. And the government in the emergency information disclosure should follow the special requirements. The second part investigates the management mechanism of foreign emergency, and analyzes the reference and inspiration to the disclosure of government information in China. The third part focuses on the analysis of the problems existing in the government information disclosure system in China, mainly on the concept level, legal system level and supporting system level. The fourth part puts forward some suggestions and measures to perfect the system of government information disclosure.
