基于案例分析的玉米品种权维权问题、启示与建议

【摘要】：近几年,植物新品种权许可使用中的侵权案件、权属纠纷案件逐渐增多,相当多的维权人由于诉讼败诉而蒙受巨大经济损失。以3个较为典型的玉米品种权纠纷案件为对象,分析案例所反映的品种权申请、保护、风险防控、价值评估和维权等问题,提出相应的解决办法和建议,为权利人维护自身权益和规避法律风险提供参考。
[Abstract]:In recent years, the infringement cases in the use of new plant variety rights have gradually increased, and quite a number of rights defenders have suffered huge economic losses due to the loss of litigation. Taking three typical cases of maize variety rights dispute as the object, this paper analyzes the application for variety rights, protection, risk prevention and control, value evaluation and rights protection, and puts forward the corresponding solutions and suggestions, which are reflected in the cases, such as application for variety rights, protection, risk prevention and control, value evaluation and protection of rights, and so on. For the obligee to protect their own rights and interests and avoid legal risks to provide a reference.
