比较法视野下中国海外能源投资保障法律机制的构建

【摘要】：同一般国际投资相比,海外能源投资无疑面临更高的投资风险,但当前我国能源投资保障法律制度却存在诸多问题。为推进我国海外能源投资事业进一步发展,保障我国海外能源投资者的安全利益,我国须将海外能源投资战略同"走出去"战略相结合,在充分考虑我国海外能源投资特点、借鉴外国海外投资保障经验的基础上,构建并完善我国自身的海外能源投资保障法律机制。
[Abstract]:Compared with the general international investment, the overseas energy investment undoubtedly faces higher investment risk, but there are many problems in the current legal system of energy investment protection in our country. In order to promote the further development of our country's overseas energy investment cause and ensure the security interests of our country's overseas energy investors, our country must combine the overseas energy investment strategy with the "going out" strategy, and fully consider the characteristics of our country's overseas energy investment. Based on the experience of overseas investment protection, the legal mechanism of overseas energy investment protection in China is established and perfected.
