机动车尾号限行法律规制研究

【摘要】:本文探讨的机动车尾号限行是是政府部门对公共交通安全进行管理的一项行政职权。随着社会经济的不断发展,我国居民的生活水平也比之前有了很大的改善,私家车数量变得越来越多,城市道路交通状况因此变得越来越糟糕,,特别是对北京、重庆、武汉等大城市来说,其交通拥堵现象十分严重。为了解决交通拥堵问题,部分城市的政府部门相继出台了机动车尾号限行等政策,尾号限行是一种行政强制措施,该措施在疏导交通、改善道路交通的通行秩序等方面起到了积极的作用。不过在实际操作过程以及理论方面,尾号限行措施还存在一定的不足,需要进一步去完善。本文在分析机动车尾号限行政策的实施现状基础上,针对其存在的问题进行了探讨,重点探讨了机动车尾号限行的法律规制,提出了法律规制的几点构想。本文主要分为以下五个部分: 第一部分是绪论,主要介绍了本文的研究目的、研究意义以及国内外关于机动车尾号限行的研究现状。 第二部分是机动车尾号限行法律规制的概述,具体介绍了机动车尾号限行的概念和特点,此外,还对机动车尾号限行的必要性进行了阐述。 第三部分是机动车尾号限行法律规制的不足,指出了我国机动车尾号限行的法律依据不足,正因为没有完善的法律制度来进行规制,导致各地机动车尾号限行存在很多的问题。 第四部分依据我国的国情和机动车尾号限行工作所存在的问题,提出了有针对性的解决方案,并指出了通过法律来规制尾号限行的几点构想。 第五部分是结论,主要对本文的研究作了系统总结,指出文中存的不足之处。
[Abstract]:The motor vehicle tail number restriction discussed in this paper is an administrative authority of the government department to manage the public traffic safety. With the continuous development of social economy, the living standards of Chinese residents have also been greatly improved, the number of private cars has become more and more, and the urban road traffic situation has become worse and worse, especially for Beijing and Chongqing. Wuhan and other big cities, its traffic congestion is very serious. In order to solve the problem of traffic congestion, government departments in some cities have successively introduced policies such as vehicle tail number restriction, which is an administrative compulsory measure to divert traffic. Improve the traffic order and other aspects of road traffic has played a positive role. But in the practical operation process and the theory aspect, the tail number limit measure also has the certain insufficiency, needs to be further consummated. Based on the analysis of the current situation of the implementation of the vehicle tail number restriction policy, this paper discusses the existing problems, focuses on the legal regulation of the motor vehicle tail number limit, and puts forward several ideas of the legal regulation. This paper is divided into the following five parts: the first part is the introduction, mainly introduces the purpose of this paper, the significance of the research and domestic and foreign research on motor vehicle tail number limit status. The second part is an overview of the legal regulation of the motor vehicle tail number restriction. The concept and characteristics of the vehicle tail number limit are introduced in detail. In addition, the necessity of the motor vehicle tail number restriction is also expounded. The third part is the insufficiency of the legal regulation of the motor vehicle tail number restriction, pointing out that the legal basis of the motor vehicle tail number limit in our country is insufficient, because there is no perfect legal system to regulate the motor vehicle tail number limit, there are a lot of problems in various places. In the fourth part, according to the situation of our country and the problems existing in the restriction of motor vehicle tail number, the author puts forward some targeted solutions, and points out some ideas of regulating the restriction of the end number by law. The fifth part is the conclusion, mainly makes the systematic summary to the research, points out the deficiency existing in this paper.
