网络食品交易第三方平台责任的理解适用与制度创新

【摘要】：新《食品安全法》规定了网络食品交易第三方平台的法律责任,包括行政责任和民事责任,民事责任体系又包括连带责任、不真正连带责任和履行事先承诺责任。这一责任与平台作为信息撮合方的地位相适应,监管部门不应轻易突破法定的责任限度。落实平台责任的相关配套规定和各地监管实践,在法定框架内积极探索制度创新。但由于平台偏重规模扩张、小微卖家定性有待明确、政府监管数据开放不够等,第三方平台责任落实仍不到位。应进一步完善和创新第三方平台责任制度,具体路径包括:贯彻社会共治理念,承认平台是共治的重要力量;技术法律监管并重,依靠技术手段破解监管难题;线上线下监管同步、建立线上线下治理联动机制。
[Abstract]:The new "Food Safety Law" stipulates the legal liability of the third party platform for online food transaction, including administrative liability and civil liability, and the civil liability system includes joint and several liability, non-genuine joint liability and responsibility to fulfill prior commitments. This responsibility and platform as an information matchmaker's status, regulators should not easily break through the legal limits of liability. Implement the relevant provisions of platform responsibility and local regulatory practice, and actively explore institutional innovation within the statutory framework. However, due to the expansion of the platform, the definition of small micro-sellers to be clear, the opening of government regulatory data is not enough, third party platform responsibility is still not in place. It is necessary to further improve and innovate the third-party platform liability system, including: implementing the concept of social co-governance, recognizing that the platform is an important force of co-governance, paying equal attention to the legal supervision of technology and relying on technical means to solve the difficult problems of supervision and control; On-line and off-line supervision synchronization, the establishment of above-line and off-line governance linkage mechanism.
