我国行政案例指导制度研究

【摘要】：2010年,《关于案例指导工作的规定》的出台,标志着案例指导制度的正式形成。行政案例指导制度作为该制度的重要构成部分,其承载着案例指导制度一般性的基础理论。但是,指导性案例在行政、刑事、民事等领域面临的难题有所差异。行政指导性案例在司法实践应用中所遇到的困境不过是案例指导制度发展的缩影,问题的根源就在于《规定》中建立起的体系。研究行政案例指导制度不仅可以改善行政诉讼,提高行政案件审判效率,对于我国案例指导制度的未来发展也将产生重要影响。研究行政案例指导制度必然不可忽视《规定》中所建构起的案例指导制度的体系。系统的把握《规定》中的内容和体系,才能够更好的针对行政案例指导制度提出一些切实可行的建议。碍于我国行政案例指导制度尚处于发展的初期,因此,借鉴域外行政判例制度的发展经验不失为完善该套制度的途径之一。文章在概括我国行政指导性案例司法实践中的难题时,通过总结近六年行政指导性案例的适用情况,概括出其效力不明确、数量不足、援引少、地方差异性、保障机制不健全等问题。总的来讲,也就是行政指导性案例在遴选机制、适用保障机制、效力争议等方面存在的问题。文章在最后,依据行政指导性案例的适用现状和问题,结合我国的具体司法实践,探讨了完善我国行政案例指导制度的对策。在效力层面,笔者主要希望通过完善适用保障机制,加之以硬性的规定,通过广泛大量的司法实践,从而达成确定行政指导性案例效力的共识。在遴选机制上,文章主要提出了扩大发布主体,也就是允许高级人民法院发布行政指导性案例,建立专门的行政指导性案例遴选委员会。在适用保障机制的完善中,主要从法律工作者的职业培训、指导性案例引用机制、行政案例背离报告机制三个角度展开了论述。总的来看,行政案例指导制度的发展状况不容乐观,回答行政指导性案例在司法实践中遇到的难题,不仅关系到其指导性价值的发挥,对于我国整体案例指导制度的发展都将产生重要影响。
[Abstract]:In 2010, the introduction of the provisions on case guidance marked the formal formation of the case guidance system. As an important part of the system, the administrative case guidance system bears the general basic theory of the case guidance system. However, the guiding cases in the administrative, criminal, civil and other areas faced with different problems. The dilemma encountered in the application of administrative guidance cases in judicial practice is only a microcosm of the development of case guidance system. The root of the problem lies in the system established in "stipulation". The study of administrative case guidance system can not only improve administrative litigation and improve the efficiency of administrative cases, but also have an important impact on the future development of our country's case guidance system. The study of the system of administrative case guidance must not ignore the system of case guidance established in stipulation. Only by grasping the content and system of "stipulation", can we put forward some practical suggestions for the administrative case guidance system. Due to the fact that the guiding system of administrative cases in our country is still in the early stage of development, it is one of the ways to perfect the system by drawing lessons from the development experience of the system of extraterritorial administrative precedents. When summarizing the difficult problems in the judicial practice of administrative guidance cases in our country, this paper summarizes the application of administrative guidance cases in the past six years, and concludes that its effectiveness is not clear, its quantity is insufficient, it is quoted less, and the local differences are also summarized. The safeguard mechanism is not perfect and so on. In general, the administrative guidance cases in the selection mechanism, the application of security mechanisms, effectiveness disputes and other problems. Finally, according to the current situation and problems of administrative guidance cases, combined with our country's specific judicial practice, this paper probes into the countermeasures to perfect our country's administrative case guidance system. In the aspect of effectiveness, the author mainly hopes to reach the consensus of determining the effectiveness of administrative guidance cases by perfecting the applicable safeguard mechanism, and through a wide range of judicial practice. In the selection mechanism, the article mainly proposes to expand the main body of publication, that is, to allow the higher people's court to issue administrative guidance cases, and to establish a special selection committee of administrative guidance cases. In the perfection of the applicable safeguard mechanism, the author mainly discusses from three angles: the professional training of legal workers, the guiding case quoting mechanism, and the administrative case deviating from the reporting mechanism. In general, the development of the administrative case guidance system is not optimistic. To answer the problems encountered in the judicial practice of administrative guidance cases is not only related to the exertion of its guiding value. The development of our country's overall case guidance system will have an important impact.
