房地产市场调控政策的法律思考

【摘要】:房价已经成为当前我国广大民众最关心的社会问题之一。高房价引起的房地产市场的过度膨胀,影响着我国经济的整体发展以及社会的全面安定。为了规范房地产市场,保证房地产市场的平稳发展,国家出台了一系列调控政策。然而密集的调控政策却没能带来房地产市场的积极改变,房价的上涨反而从几个一线城市蔓延向全国,房价持续高涨不落。这足以说明国家的调控存在一定问题。笔者针对繁杂的调控政策展开本论文的研究。首先概况了解我国的房地产市场的调控政策,再以近年的调控政策为典型进行深入解读,全面了解目前我国房地产市场政策调控的效果。其次从法律角度分析我国房地产市场调控政策存在的问题,包括政策自身的缺陷、政策的违法之处以及政策在执行中的阻碍。最后针对所提出的问题给予法律建议。第一,政策与法律的协调,笔者认为应该将法律作为调控房地产市场的主要规范,辅之以政策调控;第二,要用经济法的理念来完善政策本身,,注重适当干预和公平公正;第三,要改善政策的执行问题,首先必须协调市场各方主体的利益,其次可以通过加强法律对保障性住房建设的监督来辅助调控。
[Abstract]:Housing price has become one of the most concerned social problems in our country. The excessive expansion of the real estate market caused by high house prices affects the overall development of the economy and the overall stability of the society. In order to standardize the real estate market and ensure the smooth development of the real estate market, the state has issued a series of regulation and control policies. However, intensive regulation and control policies have not brought about positive changes in the real estate market. Instead, the rise in house prices has spread to the whole country from several first-tier cities. This is enough to show that there are certain problems in the state's regulation and control. The author carries out the research of this paper in view of the complicated regulation and control policy. First of all, we know the regulation and control policies of the real estate market in China, and then take the regulation and control policies in recent years as the typical in-depth interpretation, and fully understand the effects of the regulation and control policies of the real estate market in our country at present. Secondly, this paper analyzes the problems existing in the regulation and control policies of China's real estate market from the legal point of view, including the defects of the policies themselves, the illegal aspects of the policies and the obstacles in the implementation of the policies. Finally, legal advice is given to the problems raised. First, the coordination of policy and law, the author believes that the law should be the main regulation of the real estate market, supplemented by policy regulation, second, we should use the concept of economic law to improve the policy itself, pay attention to appropriate intervention and fairness; Third, to improve the implementation of the policy, first of all, we must coordinate the interests of all parties in the market, and secondly, we can strengthen the supervision of the construction of affordable housing by strengthening the law to assist the regulation and control.
