湖南省国有土地上房屋征收与补偿行政案件的法律分析

【摘要】：伴随着中国城市化进程的加快,国有土地上的房屋征收与补偿的纠纷也越发激烈。尽管2011年国务院出台了《国有土地上房屋征收与补偿条例》,但商品房制度推行后,拆迁的法律制度建设的远跟不上大规模的拆迁活动本身的需求。强迁等社会现象直接导致人民群众公开质疑拆迁活动的公平、公正。本文以湖南省各地州的拆迁案件为切入点,分析研究我国现行房屋拆迁中政府存在的相关问题,有着较强的理论意义和实践意义。从2012年至2014年中湖南省房屋征收类案件基本情况表明,政府作为房屋征收活动的主体和执行者,涉及到房屋征收与补偿中的行政问题主要有三点。第一,房屋征收补偿中的政府行政认定行为;第二行政机关违法采取措施的强制搬迁和强制拆除房屋的行政事实行为;第三类房屋征收补偿中的行政不作为。针对湖南省房屋拆迁中政府出现的问题和原因,也为切实解决我省、市城房屋拆迁问题。行政部门必须科学定位政府角色,自觉接受司法监督。保障征收行为的实体正义,给予被拆迁人公平合理补偿。保障征收行为的程序正义,切实增强征收环节的公开性与透明性。完善房屋信息公开、房屋征收听证制等以保障被征收人对征收活动的全程度。现有国有土地拆迁制度存在的问题颇多,本文从理论和实践两个层面提出进行改善的途径和建议。
[Abstract]:With the acceleration of urbanization in China, the dispute over the expropriation and compensation of houses on state-owned land is becoming more and more fierce. Although the State Council issued the regulations on the Collection and compensation of Houses on State-owned Land in 2011, the construction of legal system for demolition and relocation has not kept pace with the demand of large-scale demolition activities after the implementation of the commercial housing system. Forced relocation and other social phenomena directly lead the masses to openly question the fairness and fairness of demolition activities. Based on the cases of demolition in various states of Hunan Province, this paper analyzes and studies the relevant problems existing in the current housing demolition in our country, which has strong theoretical and practical significance. From 2012 to 2014, the basic situation of housing expropriation cases in Hunan Province shows that the government, as the main body and executor of housing expropriation activities, has three main administrative problems involved in housing expropriation and compensation. First, the government administrative cognizance behavior in housing collection compensation; the second administrative agency illegal measures to remove and forcibly demolish the administrative facts of the house; the third kind of house collection compensation in the administrative omission. In view of the problems and causes of the housing demolition in Hunan Province, it is also necessary to solve the problem of housing demolition in the cities of Hunan Province. Administrative departments must scientifically position the role of the government and consciously accept judicial supervision. To protect the substantive justice of expropriation and to give fair and reasonable compensation to the removed person. Safeguard the procedural justice of expropriation, and enhance the openness and transparency of expropriation. Improve the housing information disclosure, housing collection hearing system to ensure the full extent of expropriation activities. There are many problems existing in the current system of land demolition and relocation of state-owned land. This paper puts forward the ways and suggestions for improvement from the two aspects of theory and practice.
