土地隐性违法行为的表现形式和对策

【摘要】：正现行《土地管理法》自1999年实施以来,对耕地保护、合理用地、理顺土地管理程序、促进社会经济持续发展起到了重要作用,但由于立法的局限性,很难预见各类土地隐性违法行为,土地管理工作遇到了很多新问题。土地隐性违法行为的主要表现形式土地隐性违法行为介于合法与非法之间,有的在法律条款中无明确规定,有的虽有规定但无法律责任。结合对湖北远安县的调查,土地隐性违法行为主要有六种表现形式。以租代征,租用集体土地用于非农业建设。
