【摘要】：正旅游用地的概念,最早出现于1990年国务院颁布的《城镇国有土地使用权出让和转让暂行条例》,其中明确指出商业、旅游、娱乐用地土地使用权出让最高年限40年。在《土地管理法》中,建设用地也涵盖了旅游用地。2002年,国土资源部发布的《招标拍卖挂牌出让国有土地使用权规定》又特别明确了"商业、旅游、娱乐和商品住宅等各类经营性用地,必须以招标、拍卖或者挂牌方式出让"。尽管在我国现行法律和规定中都
