机动车“尾号限行”法律规制研究

【摘要】:面对日渐繁荣的物质文化生活,汽车拥堵问题已经成为当下生活中的棘手问题。本文认为,机动车“尾号限行”这一措施的行使,使行政权对公民私权造成了一定侵害,然而作为短期内对缓解交通压力行之有效的行政手段,如何能通过行政法的角度对其加以完善,减少其争议增加其效用则是本文的研究重点。 本文首先对机动车“尾号限行”进行了综合概述,简单介绍了机动车“尾号限行”的相关概念、特征、法律性质,及其理论基础等基本知识;其次,本文通过从宏观上对机动车“尾号限行”的背景与现状加以描述,为下一章机动车“尾号限行”的法理分析埋下伏笔;第三章则从合法性、合理性、程序正当性三个角度深入研究,探究该措施的法理依据是否充分;第四章,通过完善相关的法律法规使其进一步合法化,构建利益补偿机制使其更加合理,健全正当法律程序使其更趋向于公平、公正。从而,使机动车“尾号限行”这一措施的争议减少,能被更多的民众所理解,更有效地缓解行人、道路、机动车之间的矛盾,促进社会和谐。
[Abstract]:In the face of the increasingly prosperous material and cultural life, the problem of car congestion has become a thorny problem in current life. This paper holds that the exercise of the measure of "tail number restriction" of motor vehicle causes certain infringement of administrative power to citizens' private rights, however, it is an effective administrative means to alleviate traffic pressure in the short term. How to perfect it through the angle of administrative law and reduce its controversy and increase its utility is the focus of this paper. At first, this paper gives a comprehensive overview of the "tail number limit" of motor vehicle, and introduces the basic knowledge of the vehicle "tail number limit", such as the concept, characteristics, legal nature, and theoretical basis of the vehicle's "tail number limit". Secondly, this paper describes the background and current situation of the "tail number limit" of motor vehicle from the macro perspective, and lays the groundwork for the next chapter of the legal theory analysis of the "tail number limit" of motor vehicle. The third chapter is from the legitimacy, rationality, procedural legitimacy of three in-depth research, to explore the legal basis of the measure is adequate; The fourth chapter, by perfecting the relevant laws and regulations to further legalize it, construct the benefit compensation mechanism to make it more reasonable, and perfect the due process of law to make it more fair and just. As a result, the dispute on the measure of "tail limit" of motor vehicle can be reduced, which can be understood by more people, alleviate the contradiction among pedestrians, roads and motor vehicles more effectively, and promote social harmony.
