青海省冬虫夏草采集管理法律问题调研报告——以杂多县、泽库县为样本

【摘要】：冬虫夏草作为重要的自然资源,因其产量的稀缺性和实物的昂贵性,使得冬虫夏草产地的藏族农牧民对其依赖性亦愈加高,并不断改变着藏民族逐水草放牧的生活方式和生产方式。每年5、6月间,藏族农牧民在采集冬虫夏草过程中,既获得了不菲的收入,也带来了诸如生态环境破坏、行政管理成本高等亟待立法规制的问题。为此,本文根据笔者对青海省个别冬虫夏草产区的实地调查,就冬虫夏草采集的相关问题进行梳理,并提出了相应的解决之策。
[Abstract]:As an important natural resource, Cordyceps sinensis (Cordyceps sinensis) has become increasingly dependent on the Tibetan farmers and herdsmen in the origin of Cordyceps sinensis because of the scarcity of its yield and the high cost of its physical objects. And constantly changing the Tibetan people living style and production mode of herding by water and grass. In the process of collecting Cordyceps sinensis, Tibetan farmers and herdsmen not only get a good deal of income every May and June, but also bring problems such as the destruction of ecological environment and the high cost of administration. Therefore, based on the field investigation of individual Cordyceps sinensis production areas in Qinghai Province, this paper combs the related problems of Cordyceps sinensis collection and puts forward corresponding solutions.
