初探教育法学的理论体系与学科建设

【摘要】：教育法学学科体系构建的前提就是教育法学学科的理论定位、性质、内涵以及形式等。从定位角度,教育法学学科构建不但包括学科群理论体系,还包括学科的理论体系。从理论性质角度来看,教育法学是法学,是教育学二级学科,更属于教育管理学三级学科的研究范畴。在内容上,教育法以及教育法学的学科现象与理论之间存在着逻辑关系。教育法学可以以著作的形式展现也可以以教材的形式进行学科理论的展现。
[Abstract]:The prerequisite of the construction of the subject system of educational law is the theoretical orientation, nature, connotation and form of the subject of education law. From the angle of orientation, the construction of the subject of education law includes not only the theoretical system of subject group, but also the theoretical system of the subject. From the point of view of the theoretical nature, the law of education is a law of education, and it is a two-level subject of education, and is more of the research category of the three-level subject of education management. There is a logical relationship between the subject phenomenon and the theory of the education law and the law of education. The educational law can be presented in the form of a book or in the form of a teaching material.
