合作治理视域下社团规章的主要效力及其实施机制

【摘要】：合作治理是一种依规则的治理,作为治理依据的规范应该是多元的。社团规章承载着社会权力的运行与实施,社会权力奠定了社团规章的效力基础,并使社团规章呈现出较为明显的公法倾向。社团成员基于共识和信任而产生的对内在"承认规则"的自愿认同,则是社团规章效力得以彰显的内在根据。社团规章主要通过其权利和义务的确定力、制裁和实施的说服力、多元利益的实现力以及内部秩序的型构力等多方面的自治力和组织力,在国家法律缺漏的地方发挥着它的社会规范作用。社团规章的实施主要不是依赖国家强制力,为确保社团规章自主性和有效性的实施,有必要建立起社团规章的声誉惩戒、关系依赖、责任共担以及法治调控等多方面的效力实施机制。
[Abstract]:Cooperative governance is a rule-based governance, and the norms as the basis of governance should be pluralistic. The rules of association bear the operation and implementation of the social power. The social power lays the foundation of the validity of the rules of the association and makes the rules of the association show a more obvious tendency of public law. The voluntary recognition of the rules of recognition produced by the members of the association on the basis of consensus and trust is the internal basis on which the effectiveness of the rules of association can be demonstrated. The rules and regulations of associations are mainly through the determination of their rights and obligations, the persuasion of sanctions and enforcement, the realization of multiple interests, and the force of internal order, in many aspects, such as autonomy and organizational power. It plays a role as a social norm in places where national laws are lacking. In order to ensure the autonomy and effectiveness of association regulations, it is necessary to establish reputational discipline and relationship dependence of association regulations. Responsibility sharing as well as regulation and control of the rule of law and other aspects of the effectiveness of the implementation mechanism.
