兴奋剂处罚与运动员权利保障的冲突与协调

【摘要】：对体育领域使用兴奋剂的行为进行处罚,以保障赛场洁净,保护运动员健康,维护运动公平,为各国体育界共识,并在国际和国内层面形成一系列兴奋剂处罚规则。然而,兴奋剂检测与处罚规则尚存有瑕疵,给运动员造成负担,运动权利受到影响,并产生大量纠纷。因此,完善反兴奋剂规则,调整归责原则和检测方法,保障运动员的质疑及申诉权,是平衡兴奋剂处罚与运动员权利保护的重要方式。
[Abstract]:In order to ensure the cleanliness of the sports field, protect the health of athletes, safeguard the fairness of sports, punish the doping behavior in the field of sports, and form a series of doping punishment rules at the international and domestic levels for the common understanding of the sports circles of all countries. However, there are still defects in doping testing and punishment rules, which impose a burden on athletes, affect sports rights, and produce a large number of disputes. Therefore, it is an important way to balance doping punishment and athletes' rights protection by perfecting anti-doping rules, adjusting imputation principles and testing methods, and protecting athletes' right to challenge and appeal.
