我国进口食品安全监管法律问题及对策

【摘要】:食品是人类生存与发展必要的物质条件,同时更是社会发展,国家安定的根本要素。我国进口食品安全监管起步较晚,监管的法律法规、监管体制不完善,并且进口食品安全监管并没有将重心放在进口食品安全监管模式自身的建设研究上,而是集中在了学习技术等其他领域。因此导致我国开展进口食品安全监管工作时出现法律法规与之相矛盾以及各部门之间职能交叉等问题。 近年来,随着我国国民物质生活水平提高以及社会经济的不断发展,进口食品安全问题逐步成为了民生国计的关注焦点。“德国大闸蟹事件”和“新西兰进口乳制品事件”等进口食品安全事件频繁出现,直接将我国目前进口食品安全监管的不力以及管理体制不足的问题暴露无遗。强化进口食品安全管理以及加速推行进口食品安全监管体制的改革已经成了当务之急。各相关部门均在努力探寻行之有效的进口食品安全监管体制改革的方案。本文共分为四个部分: 第一部分:我国进口食品安全监管的概述。通过对食品安全、进口食品安全、进口食品监管的界定,以及对进口食品安全基本原则的阐释,分析其进口食品安全监管的必要性。 第二部分:我国进口食品安全监管现状及存在问题。通过对进口食品安全监管历史沿革和现状的分析,探讨进口食品安全存在的问题。从法律层面、技术层面、监管层面、信息层面进行分析,得出我国目前进口食品安全监管所存在的具体问题。 第三部分:域外进口食品安全监管体制的经验借鉴。通过对欧盟、美国、日本、加拿大的进口食品安全监管体制状况进行分析,进而提出对我国进口食品安全监管的启示。 第四部分:完善我国进口食品安全监管体制的具体对策。本部分是在综合前几部分的内容基础之上,分析了我国进口食品安全监管的必要性,对照我国进口食品安全监管的问题,结合域外进口食品安全监管的经验,从法律层面、技术层面、监管层面、信息层面提出一些建议。
[Abstract]:Food is not only the necessary material condition for human survival and development, but also the fundamental element of social development and national stability. China's import food safety supervision started relatively late, the regulatory laws and regulations, the regulatory system is not perfect, and import food safety supervision has not focused on the import food safety supervision mode of its own construction research. Instead, it focuses on other fields such as learning technology. Therefore, there are some problems in the supervision and control of imported food safety in China, such as the contradiction of laws and regulations and the intersection of functions among various departments. In recent years, with the improvement of national material living standards and the continuous development of social economy, the issue of imported food safety has gradually become the focus of attention of the people's livelihood. Imported food safety incidents such as "German Crab event" and "New Zealand imported Dairy Product incident" frequently appear, which directly exposed the weak supervision of imported food safety and inadequate management system in China at present. Strengthening the management of imported food safety and speeding up the reform of imported food safety supervision system has become a top priority. All the relevant departments are trying to explore an effective reform of the import food safety regulatory system. This paper is divided into four parts: the first part: an overview of imported food safety supervision in China. Through the definition of food safety, imported food supervision, as well as the interpretation of the basic principles of imported food safety, this paper analyzes the necessity of imported food safety supervision. The second part: the present situation and existing problems of import food safety supervision in China. Based on the analysis of the historical evolution and present situation of imported food safety supervision, the existing problems of imported food safety are discussed. From the legal level, technical level, regulatory level, information level analysis, the specific problems existing in the supervision of imported food safety in China are obtained. The third part: the experience of foreign import food safety supervision system. Based on the analysis of the supervision system of imported food safety in EU, the United States, Japan and Canada, the enlightenment to the supervision of imported food safety in China is put forward. The fourth part: the concrete countermeasures to perfect the supervision system of imported food safety in our country. Based on the contents of the previous parts, this part analyzes the necessity of imported food safety supervision in our country, compares the problems of imported food safety supervision in our country, and combines the experience of imported food safety supervision in foreign countries from the legal level. Technical level, regulatory level, information level put forward some suggestions.
