论风险行政法的人性预设

【摘要】:风险行政法的人性预设是"自主的-社会式"人,而不是"被动的-原子式"人。"自主的-社会式"人的基本含义是,风险行政法中的各方主体对于涉及风险行政的基本问题,有权依据自身的偏好、利益或见解来独立自主地做出决定,他们之间处于互为主体的关系;作为风险共同体成员,他们又处于互依互存的状态,对风险共同体的前途都担负着相应的责任,对于矛盾和冲突,则通过平等协商、理性沟通等和平方式来解决。将风险行政法的人性预设确立为"自主的-社会式"人的理据在于:它既可以描述由风险行政的评价性、网络性和暂时性等本质属性所决定的各方主体应当呈现的崭新的人性观,也可以通过缓解或克服风险治理中的"知识贫乏"和"价值冲突"难题来指引风险行政法的科学建构与有效实施。
[Abstract]:The human nature presupposition of risk administrative law is "independent-social" person, not "passive-atomic" person. The basic meaning of autonomous-social "human beings is that all subjects in risk administrative law have the right to make decisions independently and independently on the basis of their own preferences, interests or opinions on the basic issues related to risk administration. They are in the relationship of each other as the subject; As members of the risk community, they are in a state of mutual dependence and mutual existence, and bear the corresponding responsibility for the future of the risk community. For contradictions and conflicts, they are resolved through equal negotiation, rational communication and other peaceful means. The reason for establishing the human nature presupposition of risk administrative law as "independent-social" human is that it can describe the evaluation of risk administration. A new view of human nature that should be presented by the subjects of all parties determined by the essential attributes such as network nature and temporary nature. It can also guide the scientific construction and effective implementation of risk administrative law by alleviating or overcoming the problems of "lack of knowledge" and "value conflict" in risk management.
