我国体育行业自治及其法律规制重构

【摘要】：以体育行业规制为研究对象,主要通过文献资料法来研究体育行业规制在我国的现状,其目的在于揭示我国体育行业规制面临的困境以及对体育行业规制重构的必要性。研究从我国体育立法规制、行政规制和体育组织内部治理3方面入手,提出良善的体育行业规制应当是一个对权力进行划分、在权力之间达成制衡、为权利提供保障的过程;但目前,我国体育行业自治受到行政主导的观念和管理方式影响,总体社会化水平不高;因此,我国急需寻求一条体育行业规制转型的新道路,即从当前的权威合作治理模式,转变为国家、体育社会组织、体育个人之间相互依赖、相互制约、相互合作的多元合作治理模式。根据该初步构想,并在充分考虑我国体育发展特殊性的情况下,提出我国体育行业规制改革的具体建议:1)继续健全和完善国家体育立法;2)继续推动体育行政部门职能转换以及单项体育协会实体化改革;3)强化体育组织内部治理法治化,建立与国际评价指标体系相一致的内部治理机构和运行机制。促使国家和体育组织反思当前体育行业规制所发挥的作用。
[Abstract]:The article mainly studies the current situation of the sports industry regulation in our country by using the sports industry as the research object. The purpose of this paper is to reveal the difficult situation of the sports industry regulation in our country and the necessity of the regulation and reconstruction of the sports industry. In this paper, the author points out that the regulation of the good and good sports industry should be a process of the division of power, the balance between power and the guarantee of the right, but at present, The self-government of China's sports industry has been influenced by the concept and management of the administration, and the overall level of socialization is not high; therefore, it is in urgent need of a new way to regulate the transformation of the sports industry, that is, from the current authority cooperation governance model to the state and the sports social organization. The multi-cooperative governance model of interdependency, mutual restriction and mutual cooperation among the sports individuals. Based on the preliminary conception, and considering the particularity of our country's sports development, the author puts forward the concrete proposal of the reform of China's sports industry regulation:1) to continue to improve and perfect the national sports legislation; 2) Continue to promote the functional transformation of the sports administration and the physical reform of the individual sports associations;3) strengthen the management of the internal governance of the sports organization, and establish the internal governance mechanism and the operating mechanism consistent with the international evaluation index system. To promote the national and sports organizations to reflect on the role of the current sports industry regulation.
