基于世界卫生组织精神卫生立法检查清单的中国与印度尼西亚精神卫生法比较研究

  近年来精神障碍和社会心理问题的患病率显著增加。精神障碍患者是最脆弱的人群之一,他们的政治、经济、社会和文化权利经常被忽视,在利用卫生保健、保险、就业和住房方面也受到歧视。精神卫生立法可以提高精神障碍患者的生活水平,可以为保护精神障碍患者的基本人权提供保障,还可以为精神障碍患者的社区融合,改善其获得卫生保健的机会,保护公民权利,以及住房、教育和就业等关键问题的解决提供法律框架。精神卫生法成为促进精神障碍患者获得精神保健服务,促进和保护其权利的有效工具。事实上,精神卫生系统的建立是一个循序渐进的过程,尽管一些国家已经建立了精神卫生法,但是其精神卫生体系仍然需要进一步完善。国家需要对精神卫生立法不断进行审查、修订和修正,不断提高其质量。世界卫生组织于2005年发布了一份关于精神卫生立法的检查清单,目的是为各国制定以人权为中心的精神卫生法提供指导。这份清单不是一套绝对的规则,它有助于各国评估其精神卫生立法是否已包括了关键组成部分,也有助于拉近各国精神卫生立法与《世界人权宣言》之间的联系。目的精神卫生立法的目的是保护、促进和改善公民的生活和精神健康。制定精神卫生法可以成为保护和促进人们获得利用精...
