论我国声音商标的法律保护

【摘要】：社会的发展带动商业活动的繁荣，商业活动的繁荣也促进了商标的发展。商标的要素已经从原始的图形、文字、字母或颜色扩展到了包括声音、气味在内的组合。纵观当今各个国家的商标立法，已经有不少的国家和地区将声音商标和气味商标纳入保护范围。我国在2013年《商标法》的修订中，积极顺应国际商标发展的潮流，将声音商标纳入到商标保护的行列。这么做，一方面满足了经营者的现实需求，他们将会加快声音商标注册的步伐，挖掘声音商标所蕴含的巨大价值；另一方面，声音商标也将给消费者带来新鲜感和震撼感，商标不光能靠眼睛看见，还能被耳朵听见。声音商标能够受到商标法的保护，实属情理之中。虽然声音商标入法是商标法的一大进步，但我们仍应清楚的看到，入法之后的声音商标，无论是在授权还是在确权的过程中，都将会存在很多的问题，只有对这些问题加以解决，声音商标今后才能在我国顺利发展。但同时也要认识到，这些问题的解决不是一朝一夕的，需要我们积极借鉴其他国家和地区成熟的立法和司法经验，给予持续的研究。本文研究的目的是为了更好地对我国声音商标进行保护，加快与国际声音商标发展趋势的接轨，为推动我国知识产权战略发展、提高综合国力做出更大的贡献。本文首先以声音商标的特殊性为切入点，指出我国为什么要对声音商标给予保护。其次，分别从实质要件和程序要件两个方面介绍国外有关国家和地区以及我国关于声音商标注册的规定，指出声音商标要获得注册，必须具备显著性以及满足图样表达方式的要求，在对比的基础上，指出我国声音商标在注册过程中存在的问题。第三部分介绍声音商标的侵权和救济。在结合传统商标的侵权表现形式的基础上，，介绍声音商标主要的侵权表现及如何认定，然后提出声音商标在侵权和救济过程中存在的问题。文章最后一部分，针对文中提出的声音商标在注册和侵权救济过程中存在的问题，提出解决的建议。
[Abstract]:The development of society leads to the prosperity of commercial activities, and the prosperity of commercial activities also promotes the development of trademarks. The elements of trademarks have been extended from original graphics, words, letters or colors to include sounds. Look at the trademark legislation of every country nowadays, many countries and regions have brought sound trademark and smell trademark into the scope of protection. In 2013, the Trademark Law was revised in our country. Actively comply with the trend of international trademark development, the sound trademark into the ranks of trademark protection. Doing so, on the one hand, to meet the real needs of operators, they will speed up the pace of sound trademark registration. Excavate the huge value of sound trademark; On the other hand, the sound trademark will also give consumers a sense of freshness and shock. The trademark can not only be seen by the eyes, but also be heard by the ear. The sound trademark can be protected by trademark law. Although the sound trademark entry law is a great progress of trademark law, we should clearly see that the sound trademark after entering the law, whether in the process of authorization or in the process of confirming the right. There will be a lot of problems, only to solve these problems, sound trademark in the future can develop smoothly in China. But at the same time, we should realize that the solution of these problems is not overnight. We need to actively learn from the mature legislative and judicial experience of other countries and regions to give continuous research. The purpose of this study is to better protect our voice trademark. Speed up the development trend of international sound trademark, promote the strategic development of intellectual property rights in China, improve the overall national strength to make a greater contribution. First of all, this paper points out why our country should protect the sound trademark from the particularity of sound trademark. Respectively from the substantive elements and procedural requirements of the introduction of foreign countries and regions as well as our country on the sound trademark registration provisions, pointed out that sound trademark should be registered. Must have significance and meet the requirements of pattern expression, on the basis of comparison. The third part introduces the infringement and relief of sound trademark. Based on the combination of the traditional trademark infringement form. This paper introduces the main tort performance of sound trademark and how to identify it, and then puts forward the problems existing in the process of infringement and relief. The last part of the article. In view of the problems existing in the registration and tort remedy of the sound trademark in this paper, some suggestions are put forward.
