合肥市高新技术产业知识产权发展现状与对策研究

【摘要】：高新技术产业是由高技术成果转化形成的具有知识密集、RD投入高、附加价值高、技术进步快等特征的先导型产业。21世纪随着知识经济的兴起，知识产权在产业化发展中变的前所未有的重要，高新技术产业由于具有高智力性和高效益性，使得其和知识产权的联系越来越紧密，为此以美、日为代表的发达国家制定了促进本国高新技术产业发展的知识产权战略，以此促进现代科学技术成果向社会生产和社会生活转化，从而提高本国高新技术产业的竞争力。我国在发展高新技术产业时同样重视知识产权的作用，1999年国家科技部制定并颁布了《关于加速国家高新技术产业开发区发展的若干意见》，在该意见中明确指出，高新技术产业作为国家的支柱性产业，必须要加大智力的投入，强化知识产权的保护，自此拉开了我国高新技术产业知识产权发展的序幕。合肥作为安徽的省会城市，近年来在安徽省委的大力支持下，在以“科技兴市、知识兴市”的大背景下，合肥市高新技术产业抓住机遇，迎头赶上取得了重大的发展。然而在取得成绩的同时，我们也应看到合肥市高新技术产业在知识产权发展方面还存在着专利分布不均衡、自主知识产权缺乏、知识产权风险控制系统不健全、知识产权中介服务体系整体功能还未形成、知识产权信息公众服务平台建设滞后等问题，因此如何将知识产权更好的融入到高新技术产业，以此拉动合肥经济的发展已成为新时期合肥市政府面临的一大难题。本文从合肥高新技术产业知识产权发展的现状和原因入手，并比较研究了美国加州、中国北京知识产权发展模式，通过运用问卷调查、实证研究等方法，对合肥市高新技术产业知识产权发展现状进行了系统分析，，在总结有益经验的同时，提出了一些具体的建议。首先是要加强高新技术产业知识产权法规制度制定，为此必须做到健全高新技术产业开发区立法、完善知识产权融资法规制度以及制定促进专利技术产业化法规制度；其次要优化高新技术产业知识产权配套制度，为此需做到强化人才保障制度、完善知识产权专利联盟制度以及健全知识产权中介服务组织制度；最后必须要完善知识产权保护制度，为此须做到健全知识产权产权行政保护和司法保护。
[Abstract]:High-tech industry is a leading industry formed by the transformation of high-tech achievements with the characteristics of knowledge intensive R D with high investment high additional value and rapid technological progress with the rise of knowledge economy in the 21st century. Intellectual property has become more and more important in the development of industrialization. Because of its high intelligence and high efficiency, the relationship between intellectual property and intellectual property becomes more and more close. The developed countries represented by Japan have formulated the intellectual property strategy to promote the development of their high-tech industries, so as to promote the transformation of modern scientific and technological achievements into social production and social life. In order to improve the competitiveness of domestic high-tech industries, China also attaches importance to the role of intellectual property in the development of high-tech industries. In 1999, the Ministry of Science and Technology formulated and promulgated some opinions on speeding up the development of the National High-tech Industrial Development Zone, in which it was clearly pointed out that the high-tech industry is the pillar industry of the country. It is necessary to increase the investment of intelligence and strengthen the protection of intellectual property, which has since opened the prelude to the development of intellectual property of high and new technology industry in China. Hefei, as the capital city of Anhui Province, in recent years under the strong support of the Anhui Provincial Party Committee, under the background of "science and technology, knowledge to revitalize the city", Hefei high-tech industry seize the opportunity. Catching up with the great development, however, we should also see that there is imbalance in the distribution of patents and the lack of independent intellectual property rights in the development of intellectual property rights of high-tech industries in Hefei. The intellectual property risk control system is not perfect, the whole function of intellectual property intermediary service system has not been formed, and the construction of intellectual property information public service platform is lagging behind. Therefore, how to better integrate intellectual property rights into the high-tech industry, in order to stimulate the economic development of Hefei has become a major problem faced by the Hefei municipal government in the new period. This paper starts with the current situation and reasons of the development of intellectual property in Hefei high-tech industry, and compares the development patterns of intellectual property in California and Beijing of China. Through questionnaire survey and empirical research, this paper makes a comparative study on the development of intellectual property rights in Hefei high-tech industry. This paper makes a systematic analysis of the current situation of the development of intellectual property rights in Hefei's high-tech industry, and sums up beneficial experiences at the same time. This paper puts forward some concrete suggestions. Firstly, it is necessary to strengthen the establishment of the intellectual property laws and regulations of high-tech industries, so we must perfect the legislation of high-tech industrial development zones. Perfecting the legal system of intellectual property financing and establishing the legal system to promote the industrialization of patent technology; Secondly, it is necessary to optimize the supporting system of intellectual property of high-tech industry, so as to strengthen the talent protection system, perfect the intellectual property patent alliance system and perfect the intellectual property intermediary service organization system. Finally, we must perfect the system of intellectual property protection, so we must perfect the administrative protection and judicial protection of intellectual property rights.
