地质勘查成果的法律属性及其权益研究

【摘要】：地质勘查工作是服务于国民经济和社会发展的基础性、先行性工作。随着我国经济和社会的发展，地质勘查在支撑矿业等行业的发展方面发挥着越来越重要的作用。然而，由于我国立法上和认识上，对地质勘查成果的法律性质的模糊，对其权益内容在理论上界定的争议，使得地质勘查关系中的主体从事地质勘查积极性受到了影响，损害了地质勘查产业的发展。因此有必要对地勘成果的法律属性及其权利进行理论上的探讨。本文从地质勘查的概念、地质勘查成果的立法概念及学术界争论、地质勘查成果的分类等基本理论出发，对地质勘查成果的法律属性以及权益内容进行了研究。我国立法对地勘成果的概念及其范围进行了专门的界定，学术界对其概念也有研究，本文认为地质勘查成果是地质工作者运用地学理论与方法，，对一定区域的地层、地貌、矿产、水文等进行调查研究所形成的成果。地勘成果具有公益性、智力性、价值性。地勘成果在法律上具有财产属性，属于无形财产；地勘成果属于智力成果，是知识产权的客体。地质勘查成果是一系列权利的集合，受多种知识产权保护。从本质而言地质勘查成果属于信息专有权，受信息产权的法律保护。地勘成果中的作品具有著作权作品的特征，受著作权法律规范保护。另外，地勘成果中还有发现权以及科技成果权。
[Abstract]:Geological exploration is the basic and leading work in serving the development of national economy and society, along with the development of economy and society in our country. Geological exploration plays a more and more important role in supporting the development of mining and other industries. However, due to the legislation and understanding of our country, the legal nature of geological exploration results is vague. The controversy over the definition of its rights and interests in theory has affected the initiative of the main body in the geological exploration relationship to engage in geological exploration. It is necessary to discuss the legal attributes and rights of geological prospecting achievements in theory. In this paper, the concept of geological exploration, the legislative concept of geological exploration results and the academic controversy, the classification of geological exploration results and other basic theories. The legal attribute and the content of rights and interests of geological exploration results are studied. The concept and scope of geological prospecting results are specially defined in our country's legislation, and the academic circles have also studied the concept. This paper holds that geological exploration results are geologists' application of geoscience theories and methods. The results of investigation and research on stratum, geomorphology, mineral resources and hydrology of a certain area. The results of geological prospecting are of public welfare, intelligence and value. The results of geological prospecting have property attribute in law. Belonging to intangible property; Geological prospecting results belong to intellectual achievements and are the object of intellectual property. Geological exploration results are a collection of rights and are protected by various intellectual property rights. In essence, geological exploration results belong to the exclusive right of information. The works in geological prospecting results have the characteristics of copyright works and are protected by copyright law. In addition, the rights of discovery and scientific and technological achievements are also included in geological prospecting achievements.
