山东省知识产权制度研究

【摘要】：随着经济全球化和国际贸易自由化进程的加快,人类社会已然进入了知识经济时代,知识产权在国际经贸中发挥着越来越重要的作用。各国在知识产权创造、保护、管理和运用方面能力的高低直接决定了其在国际社会中的竞争力,也越来越重视知识产权在激发人类发明创造意识,推动科学技术和文化繁荣中的作用。立足于知识经济、信息技术快速发展的国际背景,世界各发达国家结合本国实际情况,不断地调整和完善本国的知识产权制度。上世纪八十年代,我国才开始建立知识产权制度,成为指导知识产权各项工作的一项基本制度。加入WTO以后,我国的知识产权制度迎来了前所未有的挑战,如何实现我国知识产权制度与世界贸易组织《知识产权协定》(TRIPS)的有效接轨,如何运用知识产权制度提升我国在国际社会中竞争力,成为我国知识产权制度建设的重要任务。本文以山东省实施知识产权战略,实现山东省由知识产权大省向知识产权强省的转变为分析背景,分析了山东省知识产权制度实施进程中在规章制度建设,知识产权创造、保护、管理和运用能力方面取得的成果。在看到知识产权制度实施取得显著成果的同时,也看到了知识产权制度在创造、运用、保护、管理和人才培养制度方面还存在一些问题：如知识产权创造资金投入政策不完善、知识产权成果转化机制不健全、知识产权行政保护和司法保护机制不健全、统筹协调管理机制不平衡、人才培养和教育机制不完善等一系列的问题。这些问题的存在直接影响了山东省知识产权各项事业的健康有序发展,减缓了山东省向知识产权强省迈进的步调。最后,针对山东省知识产权制度实施进程中的现状和问题,本文提出了一些具有针对性的建议：如完善知识产权创造政策和机制；健全知识产权转化与交易机制,促进知识产权成果产业化；改善知识产权保护环境,加强知识产权保护制度建设；完善知识产权管理体制,提升政府知识产权管理能力；健全知识产权人才培养教育体系,提升知识产权人才素质等方面的政策建议,从而能够有效地完善现有的知识产权制度,使其能够更好地为建设创新型山东服务。
[Abstract]:With the acceleration of the process of economic globalization and international trade liberalization, human society has entered the era of knowledge economy, intellectual property rights play an increasingly important role in international economy and trade. The ability of management and application directly determines its competitiveness in the international community, and pays more and more attention to the role of intellectual property in stimulating the consciousness of human invention and creation and promoting the prosperity of science, technology and culture. In the international context of the rapid development of information technology, the developed countries in the world have constantly adjusted and improved their intellectual property rights system in the light of their actual conditions. In -20s, China began to establish the intellectual property rights system. It has become a basic system to guide the work of intellectual property. After China's entry into WTO, the intellectual property system of our country has faced unprecedented challenges. How to realize the effective connection between China's intellectual property system and the World Trade Organization (WTO) intellectual property Agreement (trips) and how to use the intellectual property system to enhance the competitiveness of our country in the international community has become an important task in the construction of our intellectual property system. Based on the transformation of Shandong Province from a big province of intellectual property to a strong province of intellectual property, this paper analyzes the construction of rules and regulations and the creation of intellectual property in the process of implementing the intellectual property system in Shandong Province. The achievements in the protection, management and application of the intellectual property system. While the implementation of the intellectual property system has achieved remarkable results, it has also seen the creation, application and protection of the intellectual property system. There are still some problems in the management and personnel training system, such as the imperfect investment policy for intellectual property creation, the imperfect mechanism for transforming intellectual property achievements, the imperfect administrative and judicial protection mechanisms for intellectual property rights, A series of problems, such as the imbalance of the overall and coordinated management mechanism, the imperfect training of talents and the imperfect educational mechanism, have directly affected the healthy and orderly development of the various undertakings of intellectual property in Shandong Province. Has slowed the Shandong Province to the intellectual property rights strong province stride forward the pace. Finally, in view of the current situation and problems in the process of implementing the intellectual property system in Shandong Province, this paper puts forward some pertinent suggestions, such as perfecting the policy and mechanism of intellectual property creation, perfecting the mechanism of intellectual property transformation and transaction, To promote the industrialization of intellectual property achievements; to improve the environment for intellectual property protection and strengthen the construction of intellectual property protection system; to improve the intellectual property management system and enhance the government's intellectual property management capability; to improve the intellectual property personnel training and education system; In order to improve the quality of intellectual property talents and other policies, it can effectively improve the existing intellectual property system and make it better serve for the construction of innovative Shandong.
