【摘要】：互联网从20世纪60年代美国军方对抗核武器打击的一个冷战工具，发展成为信息社会的重要基础设施，它的发展速度之快令世人瞩目。80年代之后，互联网开始用于科研活动。90年代中期以后，，伴随互联网的飞速发展，人类进入了网络时代。社会的任何进步和新生事物的出现，随之而来的是法律问题，因此网络的出现也对各国的传统法律制度提出了严峻挑战。在中国特色社会主义法律体系已经形成，同时我国网民规模位居世界第一的今天，对我国的网络立法问题进行研究，不断健全和完善我国网络立法，不仅任务紧迫，而且具有重要的现实意义。文章在前人研究成果的基础上，通过分析网络立法问题，针对我国实际情况，提出了完善中国特色社会主义网络立法的重要意义和加强我国网络立法的具体策略，以期为我国网络法的建设贡献一份力量。首先，文章从互联网给传统社会法律制度带来冲击的角度入手，阐述了网络给传统法律规范中涉人概念、涉事概念、涉物概念造成的影响，以及由此产生的法律问题，概括为网络安全问题、信息网络经营问题、电子商务的法律问题、网络知识产权问题和程序法律问题。其次，本文介绍了中国特色社会主义网络立法概况。在对网络法律、网络立法的概念进行界定的基础上，分析了我国网络立法的进程和特点，将其分为初创、成熟、推进三个阶段。再次，文章重点分析了当前我国网络立法存在的问题及其产生的原因。归纳起来，现行网络立法的问题主要表现为结构性缺陷、内容性缺陷以及协调性缺陷。而网络立法存在缺陷的原因是网络法律意识欠缺、动态性的法制环境造成的法律尴尬、行政部门多头管理、多头立法造成相互矛盾以及立法过程缺乏民众参与几个方面。最后，提出了完善网络立法的意义、指导思想和基本原则，详细阐述了完善我国网络立法的策略：制定网络基本法、填补网络法律法规空白、完善现行网络法律法规。同时关注了我国网络立法的几个重点问题，主要是网络安全、电子商务、网络著作权、网络语言暴力以及网络犯罪五大问题。
[Abstract]:The Internet has become an important infrastructure in the information society from the Cold War tool of the US military to the attack of nuclear weapons in 1960s. Its speed of development has attracted worldwide attention since the 1980s. Since the Internet began to be used in scientific research activities in the mid-1990s, with the rapid development of the Internet, human beings have entered the network era. Any progress in society and the emergence of new things, followed by legal problems. Therefore, the emergence of the network has also posed a severe challenge to the traditional legal systems of various countries. At the same time, when the legal system of socialism with Chinese characteristics has been formed and the scale of Chinese Internet users ranks first in the world, the issue of network legislation in our country has been studied. It is not only urgent to perfect and perfect the network legislation of our country, but also of great practical significance. Based on the previous research results, this paper analyzes the problems of network legislation, aiming at the actual situation of our country. This paper puts forward the significance of perfecting the network legislation of socialism with Chinese characteristics and the concrete strategy of strengthening the network legislation of our country in order to contribute to the construction of our country's network law. First of all, from the point of view of the impact of the Internet on the traditional social legal system, this paper expounds the concept of the person involved, the concept of the matter involved, the concept of the matter involved, and the legal problems arising therefrom in the traditional legal norms of the Internet. It is summarized as network security problem, information network management problem, electronic commerce law problem, network intellectual property problem and procedure law problem. Secondly, this paper introduces the general situation of the network legislation of socialism with Chinese characteristics. On the basis of defining the concept of network law and network legislation, this paper analyzes the process and characteristics of our country's network legislation, and divides it into initial and mature. Advance three stages. Thirdly, the article analyzes the existing problems and the causes of the current network legislation in our country. In summary, the problems of the current network legislation are mainly manifested as structural defects. The defects of network legislation are due to the lack of network legal consciousness, the embarrassment of law caused by the dynamic legal environment, and the administrative departments' multiple management. The long-term legislation results in contradiction and the lack of popular participation in the legislative process. Finally, the paper puts forward the significance, guiding ideology and basic principles of perfecting the network legislation, and expounds in detail the strategies of perfecting the network legislation in our country: making the basic law of the network, filling in the blank of the laws and regulations of the network, At the same time, it pays close attention to several key issues of our country's network legislation, such as network security, electronic commerce, network copyright, network language violence and network crime.
